A federal appeals court has thrown out a $1.8 million judgment awarded to former Minnesota Gov. Jesse Ventura, who says he was defamed in the late author Chris Kyle's bestselling book "American Sniper."
The 8th U.S. Circuit Court of Appeals on Monday rejected the jury's 2014 award of $500,000 for defamation and $1.3 million for unjust enrichment against Kyle's estate.
The court reversed the unjust-enrichment award, saying it fails as a matter of law. It also vacated the defamation award, but ordered a new trial for that portion of the case.
Kyle, a Navy SEAL and the deadliest sniper in U.S. military history, claimed to have punched Ventura at a California bar in 2006 after Ventura said the SEALs "deserve to lose a few" in Iraq.
Ventura, a former SEAL, testified he never made the comments and that the altercation never happened.

"The standard that must be met to win a defamation case is near impossible to meet for public figures. They have to prove actual malice, and truth is an absolute defense. That is why these cases are rare. Even if someone is lying, proving actual malice is near impossible due to how high the bar is regarding what public figures must prove.
In the Ventura case, the jury was instructed that they had to prove with clear and convincing evidence that Kyle either knew or believed what he wrote was untrue, or that he harbored serious doubts about its truth. The suit was brought long before he died. Ventura didn't sue a widow. She became a widow after the case had already being going on. There were hours of testimony of Kyle on tape.
When Ventura's name was linked to the book, two things happened. The sale of the book, which was previously struggling, suddenly sky rocketed when Ventura was named as Scruff Face. The other thing that happened was that Ventura lost his show, his reputation was damaged meaning he couldn't get work, and he was publicly being shamed.
His ability to earn money was terrible undermined while Kyle's earnings skyrocketed. It was also determined that at least one other story in the book was also untrue. The high standards that must be proved were often mentioned in the media before the trial, but after actual malice was proven enough to meet this high standard, the media seemed to forget all about this fact after the case.
Understanding well how Public Relations works, I don't believe it was Kyle's idea to do this. I believe that a Public Relations agent knowing that Ventura is disliked by the left and the right strongly urged Kyle to link Ventura to the book because of how easily it would draw attention to the book from all media outlooks while also causing universal alignment with Kyle and against Ventura, making sales sky rocket."

Cute, but the lawsuit was already on. And it’s pretty clear Kyle said a lot of things. I refuse to call them lies. They were sea stories and fun BS that just got too big to stop when he became famous.
Like the claim he killed two carjackers, and the cops were given a number at the pentagon to call, and were told it was cool and they had to let him go. Never happened.
Or that he was sniping at the Superdome in Katrina.
He got caught up in the BS, he wasn’t a liar. But he never should have confirmed in that interview that it was ventura.
Even the look on his face when he said ,yeah, scruffy face was ventura...it was obvious he was full of it.
But this has all gone on way too long.
Kyle was a good warrior, probably a fun guy, loved his family. He wasn’t a perfect God and it’s idiotic to idolize him. He deserves to rest now.
Ventura’s ego can’t stand that Kyle cold cocked him to shut his obnoxious mouth in that bar. Multiple witnesses testified to the scuffle at the trial. Ventura who is a lowlife slimeball running low on income tried to cash in. He’s getting his just deserts now. Chris Kyle was a hero.
