Well... I think you are referring to the 'legal' meaning, and the author (as well as many posters here) may be referring to the more archaic meaning.

If you had actually read the article, instead of jumping in to defend the rapist, you would have read that NY law allows you to use deadly force to prevent a criminal from escaping. Go ahead and charge the guy. A jury will cut him loose in a NY minute.
He could have performed a citizens arrest in most states. Then when the bad guy resisted with deadly force, he could have used deadly force. Just sayin’ . . .

From his story, he could be said to be defending both her and himself as the guy allegedly tried to grab the crowbar and struck him - who is to say that the guy would have just fled and not opted to get rid of the witnesses?
I've reached the point where an escaping criminal means less than nothing to me. The law may say he's no longer a threat, but that doesn't take away the damage done to the victim. Had the husband walked in two minutes earlier, and done the same thing, while the criminal was in the act, the husband would be good to go, but because the criminal was now done with his act, and on his way to his next venture, he deserves a free pass? Makes less and less sense the more you think about it.
This is true, if the facts of the story is true. I’d never convict on a jury if I was presented with evidence that backs up the accused’s story.
