I think your analysis is spot-on.
Clinton is going to try and say Pagliano wasn’t an employee but an independent contractor doing unauthorized work.
If he was an agent and Her Thighness was his principal, she could be responsible for any actions by him within the scope of his employment.
There’s a legal test to determine whether someone is an independent contractor, but I thought this was settled, that he was on her payroll, an state dept. employee.
If this is an affirmative defense, it doesn’t look like much.
Yeah, I did some reasearch. Pagliano was with the Information Resource Management Bureau and left the State Department in 2013.
He failed to report income from Hillary on State Dept. financial disclosure forms for work she paid him to do, so that’s prolly where they are going, hanging it on the guy with immunity: “Our client depended on Bryan completely, why, she didn’t even know to have an e-mail password.”
Why would they give him immunity?
Because ‘they’ are the Justice dept.
I thought immunity took care of that ?

I'm still not convinced that the FBI isn't going to cover for hillary by letting Pagliano skate, even if he gives them essentially nothing. Normally, when immunity is granted, the granting party already knows almost everything he's going to say. I don't think that is true in this case. He may well have sold them a pig in a poke, and they'll let him, because:hillary.
The evidence is overwhelming that Comey should recommend an indictment, but the real question is will the FBI meet this titanic test of integrity and the Rule of Law or will the Clintons once again elude accountability for their actions? If the FBI fails the test, then the veil will be lifted on the extent of the corruption and rot that permeates the highest levels of our government, including the career bureaucracy. In sum, the country is finished because equal treatment under the law has been destroyed and is irretrievable.
