Feds admit FBI agents shouldn't have questioned Oregon standoff defendant David Fry

FBI agents shouldn't have questioned Oregon standoff figure David Fry after taking him into custody Feb. 11 because his attorney already had invoked Fry's right to remain silent, federal prosecutors admitted Wednesday.

"The government acknowledges that agents should not have questioned him," Assistant U.S.Attorney Ethan Knight wrote in a legal brief.

Fry's attorney, Per C. Olson, had contacted Knight and Oregon's federal public defender earlier Feb. 11, asking them to contact the FBI to relay his request to speak with Fry and his desire that Fry not answer any questions from police once he was arrested.

Olson contacted Knight at 11:07 am. Four minutes later, Knight emailed two FBI supervisors, supervisory special agent Gary Adler and special agent Rich Baltzersen, to notify them that Olson had invoked Fry's right to remain silent.

Adler and Baltzersen were the lead agents responsible for the criminal investigaton of Fry and had been in direct contact with the U.S. Attorney regarding the inquiry. They were working out of Portland, according to Knight's document.

About 10 minutes later, Adler forwarded Knight's email to 'multiple FBI personnel" in Burns.

Why that communication didn't stop FBI agents Sean Hamblet and Eric Thompson from interviewing Fry isn't explained in the prosecutor's memo......

Heck, they don't make them FBI agents like Efrem Zimbalist anymore.

David Fry is human and 'flawed' as some have said, but I appreciate his getting the message out from the protest when he and the three others were left.

Fry had to deal not just with the FBI siege tactics but also with the disinformation and disruptive tactics of the Pacific Patriots Network who accused him of wanting violence.

I think part of the PPN anti-Fry message has been spreading the notion Fry was an FBI plant.

I tend to agree with blogger Gary Hunt on "Outpost of Freedom" regarding the PPN people being troublemakers doing the bidding of someone else, themselves the FBI is what he speculates.

My politically sensitive feelings are that the PPN folks, who mirrored the Republican Party's presidential candidates in calling for an end to the protest in Oregon, were perhaps motivated by the need to shut Ammon Bundy down for the benefit of the GOP.

PPN switched all over the place from opposition to 'support' to cut and run when the FBI moved in to arrest people on January 26th.

If you’re a transvestite, it’s YOUR central socialist government. If you’re only a taxpayer it’s your sworn enemy.

Today 80% of the attorneys who draw checks from the central government under the pretense that they’re employees of the Justice Department are working on the serious problem with bathrooms. Far less than 1% comprise the ranks of the gender confused perverts.

Those who make it difficult for male perverts to use female bathrooms will be prosecuted.

Everytime I read the comments at oregonlive I am stunned. The people losting really have forgotten what it is to be an American. I mean most on there today could care less that the FBI was basically stomping in the constitutional right of an American citizen.

Funny thing is I am sure they would suddenly care about constitutional rights if they were the ones in the back of that car.
