Could a perspective couple sign a M.A.D. pre-nup? In case divorce is initiated, all wealth from both parties goes to charity.

Could a perspective couple sign a M.A.D. pre-nup? In case divorce is initiated, all wealth from both parties goes to charity. That would enable either partner to punish the other at will. It would also enable either partner to violate their vows repeatedly - as long as they could reasonably bet that their spouse would not want to lose it all.
I do not see such an agreement as a positive thing.
