North Carolina files lawsuit against the federal government over ‘bathroom bill’
Washington Post ^ | Mark Berman

North Carolina governor Pat McCrory filed a lawsuit Monday against the United States Justice Department, asking a federal court to rule that its so-called “bathroom law” is not discriminatory. In his complaint, McCrory (R) accused the federal government of “baseless and blatant overreach.”

“The Obama administration is bypassing Congress by attempting to rewrite the law and set restroom policies for public and private employers across the country, not just North Carolina,” McCrory said in a related statement. “This is now a national issue that applies to every state and it needs to be resolved at the federal level.”

Beyond the bathroom, a case with MAJOR implications for the future of Federalism.

You do NOT want Hillary appointing the judge who will decide this one!

I don’t understand the liberal logic on this.

1. Charlotte passed a “non-discrimination” law, which allows men who “identify” as women, to go in women’s restrooms and locker rooms.

2. The state of North Carolina passed a law to override and roll back the Charlotte law, which went too far. The North Carolina law simply restored the status quo on restrooms.

3. For restoring the status quo on restroom status, the state of North Carolina is now threatened by the federal government with passing a “disciminatory” law. And there are threats that NC could lose federal funds and have other legal troubles. Liberals on TV tell us that this is a return to Jim Crow and other similar overreactions.

4. The LGBT peoples, cross dressers, people who are confused about sexual identity, people who have had sex change operations, etc. are NOT protected classes of people under federal civil rights laws.

5. Since these people are NOT covered under civil rights laws, how are the actions of North Carolina any business of the federal government and Obama and the Justice Department in the first place????

Bring on the lawsuit. Any fair minded judge should enjoin the federal government from any action based on some key points such as I have raised here. We’ll see what happens.

Open question: Did “traditional” (funny word to use, I know) trannies get state IDs reissued showing their chosen “gender?”

If a guy takes out his flag and waves it in public, he's a sex criminal for life. If he's relating to his inner female (or whatever) and goes in a Girl's Room to pee, he's protected by federal law.

It's insanity.

Any “fair minded judge” should...

OK, now there’s the problem.

Was the Charlotte law just about publicly owned restrooms or all restrooms? Was the NC state law about publicly owned restrooms or all restrooms?

Thank you for that. I’ll be adding that to my pubic discourse on this subject (NC resident here).

And no, that wasn’t a typo...

This is the recently updated Charlotte anti-discrimination ordinance that was overridden by NC HB2:

“It shall be unlawful to deny any person the full and equal enjoyment of the goods, services, facilities, privileges, advantages, and accommodations of a place of public accommodation because of race, color, religion, sex, familial status, marital status, sexual orientation, gender identity, gender expression, or national origin.”

It was about a LOT more than bathrooms.

So the Charlotte law was any privately owned bathroom or previously sex exclusive area? What about the NC state law?

Actually, they do, once “conversion therapy” (i.e. hormone injections) has started. At least in Maryland.

A co-worker of mine went from F->M. I had previously thought she was just a “traditional” bull dyke. They were showing their new driver’s license (and Social Security number) the day after their petition was approved. . . .

You're right - it was about a lot more than bathrooms. The mayor of Charlotte, Jennifer Roberts, is a flaming liberal. She teamed up with a guy who was pushing this. It turns out he is a registered sex offender! That's right - he is a former minister who was sexually assaulting the young men in his church. Now he wants men going into women's bathrooms and showers.

This ordinance was voted down a year ago and the liberal mayor pushed it again. She was told by the governor in no uncertain terms not to do it. She did it anyway because she is unhappy with the majority Republican state legislature and wanted to irritate the R governor.

I wonder if the people of Charlotte will elect her in the next election. They have been very hurt financially but this fiasco.

I’ve seen it stated both ways per the NC law, that businesses can choose who uses their bathrooms or it is mandated that you have to go into the bathroom/area that corresponds to the sex on your birth certificate. But maybe the birth certificate thing is only for publically owned restrooms/areas?
