Well, yeah, anyone who doesn’t like Obama’s dictatorial usurpation of the Constitution would welcome it because a tie means the lower court ruling stands.
Has Cruz ever said anything about impeaching Obama? As an elected representative of the people, sworn to uphold the Constitution and obligated to defend the Constitution?

Furthermore, as in many things, he discusses things in a Constitutionally-minded logical adult non-populist way. Speaking as a Senator, notes that the house is responsible for impeachment, and if they do their duty, he would do his to render judgement in the Senate.
