Governor Christie Acts to Improve NJ Gun Permit System

Governor Christie

Governor Christie of New Jersey is pushing to make some incremental changes to improve the arcane and inconsistent New Jersey firearms licensing system. From capemaycountyherald:

TRENTON — Acting on Governor Chris Christie’s commitment to ensure fair and consistent application of the state’s gun laws that respects individual’s Second Amendment rights and protects public safety, the Office of Attorney General announced a directive and guideline issued by Acting Attorney General Robert Lougy, and a regulatory change to align the regulations governing the issuance of a carry permit with New Jersey Supreme Court precedent interpreting the statutory standard of justifiable need. Taken together, the changes will help ensure all applicants receive efficient and uniform consideration in the processing of firearm permit applications.

The change in the regulation for the issuing of carry permits opens the possibility of people other than former police officers, judges, or the politically connected to obtain permits.  From the proposed change(pdf):

In practical application, this change will allow the chief of police or the Superintendent, as the case may be, to consider evidence of serious threats that are not directed specifically at an individual and that establish more than mere generalized fears or concerns. That is, there may be circumstances that pose a sufficiently concrete threat to warrant the issuance of a permit (establishing the requisite urgent necessity for self-protection) but that do not yet involve a specific threat directed at a particular individual. For example, one such situation could be a taxi driver who works nights in a particular precinct where armed assailants recently and on multiple occasions had flagged down cabs at night and robbed and shot the drivers...

A small step forward. It was motivated in part, by the AG office being forced to pay 100K in lawyers fees to NJ2A, when the AG refused a valid FOIA request to learn the process the state police used to grant/deny permits.

That’s mighty white of him to consider giving people a tiny chance of getting their CONSTITUTIONAL RIGHTS.

Anything less than “shall not be infringed” should be ruled unconstitutional, the city found in contempt and over run by the locals. What has happened to our country?

He got beaten up on the campaign trail for being from an anti-civil rights state.

While it may make sense to do what he is doing alone, one cannot dismiss the benefit to future campaigns.

I don’t see the language “justifiable need” anywhere in the second amendment.

I am amazed at the lassitude of NJ voters in this regard. When good men do nothing you lose your rights.

Man up people and start recalling state legislators. Only a few need to be thrown out, the others will fall in line.

I don’t see the language “justifiable need” anywhere in the second amendment.

I don't see "permit" in there, either. Nor do I see "assault weapon", "high capacity magazine", "machinegun", "short barreled rifle", "suppressor", "Federal Firearms License" ...

Just "arms". Generically. Any "arms".

The right to keep them, and the right to bear them shall not be infringed.

Problem Solved:

Any person granted a “Privilege” to “keep and bear arms, without being infringed” shall be prohibited from using that privilege in the defense of others for profit or gain.

Any person violating this law shall be guilty of a Felony, Punishable by a mandatory sentence of not less than 25 years in Prison.

There are NO POLICE OFFICERS or any other person in “Law Enforcement” anywhere in the US, that has a “Duty” to protect the citizenry. The Only “Legal Duty” any Police Officer has,is to the political entity that employs them.

This would eliminate ALL Private Body Guards from carrying guns to protect the elitist ruling class and HOLLYWOOD.

If it is a RIGHT then you can use your gun in defense of others, if it is a “PRIVILEGE” then it is a FELONY TO DO SO.

Pass this law and watch them change their tune overnight.

You’re ~100yrs+ too late to be asking.

Lincoln, Teddy, Wilson, FDR, on and on to the Left we’ve leaned.

Lost a Republic w/out a shot.

Love it. Bears repeating.

I would change the 1st part only slightly:

Any person granted a privilege, by suppressing the Right(s) of others or creating ‘privileged classes’, shall be prohibited from using that privilege for the benefit of others, for profit or gain.

No more AA, ‘healthcare’, etc.

More mealy-mouth BS from Christie. This is pure window dressing and there's no effective change in law, regardless of how the pol's want to position it. I'll never be able to legally carry in this crap-hole of a state as long as Cody and Weinberg run the tables in Trenton.

Only the privileged few get to carry legally in NJ. All others are felons in the making and Trenton likes it that way.

Apparently State AGs can pick and choose which laws they defend. If Christie were serious he and the AG might go,that route.

The AG who was in charge during the FOIA fiasco is no longer in charge. The deputy AG is now the acting AG.

Whether there is any connection between these events is not stated.

It’s nt a “need”, it’s a “right”. Need has nothing to do with it.

It doesn't matter. ANY licensing, permit or other requirement for ownership or bearing of arms is an unconstitutional infringement upon the right recognized in the second amendment.

Thanks. Not only did I learn a new word - lassitude, I have found to be living it.
