No. He can't sue because he is a public figure.

A public figure cannot sue on the basis of incorrect, harmful statements. He’d have to prove that the NE knowing published false statements with malice. There is no way to prove that NE acted with malice. They write sensationalized stories designed to get publicity. That’s not malice.

Good post on the NE.

You can be sure every article is vetted by attorneys who live in libel-land.

It is Ted’s bible pounding and family values claims that makes him so vulnerable on this issue—if he campaigned as a free love hedonist this would not be an issue.
