Second judge opens door to depositions in Clinton email case

A second federal judge is opening the door to allowing current and former federal officials to answer questions under oath in an ongoing legal battle over Hillary Clinton’s private email server.

Citing “evidence of government wrong-doing and bad faith,” Judge Royce Lamberth of the U.S. District Court for the District of Columbia ordered that conservative legal watchdog group Judicial Watch could begin a limited version of the evidence-gathering process known as discovery.

The Obama administration has offered “constantly shifting admissions” about the state of Clinton’s server, Lamberth added in his Tuesday order, raising questions about the extent of her use of the server and the government's role in setting it up. The ruling represents growing frustration with the State Department’s responsiveness to federal records laws, following a similar order from another federal judge earlier this year.

The decision is likely to only further inflame the mounting scrutiny on Clinton’s bespoke email arrangement, which has dogged her presidential campaign. A lingering court battle about the State Department's compliance with federal records laws is likely to stretch well into the general election.

In the first case, which also involves Judicial Watch, Judge Emmet Sullivan questioned whether top State Department figures had intentionally tried to skirt the Freedom of Information Act (FOIA) by allowing Clinton to exclusively use her private email server throughout her time as secretary of State.

This month, Judicial Watch submitted a list of eight current and former State Department officials that it hoped would testify about their role facilitating Clinton’s use of the “homebrew” email system. The judge in that case has until April 15 to decide whether or not to proceed.

Because the process is already moving forward in the case before Sullivan, Judge Lamberth’s order on Tuesday is likely to have a limited practical effect.

the BEST thing to happen is Hillary wins the primary without being indicted.

so many liberals in Manhattan are telling me they just might stay home if she wins in protest.

The first issue is whether all of Hillary’s minions will take the 5th after answering their names. They can take the 5th in a civil case, and I’m guessing they will. That of course would be damning to Hillary’s campaign in itself. The public perception is that only guilty people do that.

The other issue is whether Judicial Watch believes they already have enough rock-solid evidence to make a deposition effective. Given the Clinton’s ability to parse their words, it will require some solid and persistent lawyering to pin them down. And then it’s only effective if you have the known facts from the servers to put them into the Hobbes’ choice of either lying or confessing a crime.

She will get the nomination and as the election gets closer they will talk themselves into believing that the (R) nominee, no matter who it is, plans on reinstating slavery, killing muzzies and homos, handing out coat hangers to pregnant liberals, and pouring lead into all municipal drinking water. Then they will throw the switch for her saying they have to do it in order to save us all.

I won't deny that any is better than none. But since the Dem vote fraud machine gets bigger every election, and will be beyond belief this time around, I don't think 2% would matter.

i’m REALLY concerned about that.

I don’t think obummer, jarrett, hitlary et. al. have ANY intention of playing remotely fair or handing over power, and we know there’s a program out there that can rig an election.

I Have NO IDEA how that last part works, but read about it on here.

I hope that JW will, among much else, depose State Department people about:
1) who supervised Bryan Pagliano (apparently Patrick Kennedy, who denies having anything to do with him after hiring him);
2) what work BP did for the DoS, if any, and when;
3) was BP responsible for security certifications regarding Clinton’s communications;
4) why DoS paid him as a consultant even after Clinton left office (exactly what were his duties?).
5) whether they saw Clinton using her Blackberry in a “SCIF”.
6) everything employees were told regarding re-sending classified information to Clinton.

7) What specific security clearances did BP have?
8) When did he receive them, and by whose authorization?
9) What training or coordination did he have with DoS IT/Security personnel?
10) Was he given any written instructions, either on paper or electronically, for setting up SoS communications?
11) From whom, and when, did he receive these instructions?
12) What security protocols were used on SoS communications?
13) What access did he have to SoS communications?
14) Did he save in any digital form or paper form the content of any communications from or to any person, that passed through the system he set up?
