“He is against H1-B visas but uses them in his businesses.”

It is a legitimate query. Why should we listen to him when he uses H1-B visas which take jobs from Americans?

But it is also an ad hominem tu quoque fallacy (Latin for, “you also”).
The appeal to hypocrisy is an informal logical fallacy that intends to discredit the validity of the opponent’s logical argument by asserting the opponent’s failure to act consistently in accordance with its conclusion(s).

A tu quoque “argument” follows the pattern:
Person A makes claim X.
Person B asserts that A’s actions or past claims are inconsistent with the truth of claim X.
Therefore X is false.
An example would be
Donald Trump agrees with the GOP-e to an extent in believing our immigration is broken and must be reformed from the ground up. But not by simply granting another general amnesty.
5th generation Texan says, “He is against H1-B visas but uses them in his businesses.”
Consequently Trump’s position is false.

H1-B Visas are perfectly legal. As are EPA, OSHA and EOE regulations. Trump uses the law and complies with the law in his businesses, but he wants to change them.
He has said he will abolish the EPA along with countless other agencies he has undoubtedly wrangled with over the years, `Brazil’-like, officious leeches that have proliferated under both parties and burdened businesses, eating out their (and our) substance.

The most recent example is the Affordable Care act which has worked the result that American businesses won’t hire new workers at more than 30 hours a week in order that they do not fall within the mandate of Obamacare.

Trump isn’t Microsoft or anyone of the countless other e-businesses that hire legal visa holders (notably Indians) who work for less, are docile and no threat to management. There are plenty of Americans who would love to have one of these jobs.
Trump said he uses H1-B workers to do the scut work at his hotels and resorts, that the jobs have been advertised but they cannot get American workers to swab toilets.
Once the border is secured and squatting illegals have been returned to their own country(ies), as he has also promised, we can begin admitting legal alien workers to do the jobs Americans actually won’t do.
OTOH, those who enjoy paying less than subsistence wages to docile illegals to landscape their yards, make their beds, clean their pools, care for their children—they are going to be SOL.

I hope you found this useful FRiend.

H-1B are for professionals, software, IT, doctors etc. Trump doesn't employ those and doesn't use or want H-1B visa.
