Guilty verdict in Santa Rosa ‘sleepwalker’ case

Jurors returned a guilty verdict Wednesday against a Santa Rosa man who claimed he could not be held responsible for molesting a 13-year-old girl because he was sleepwalking.

Loren Rodriguez-Martinez, 60, now faces up to eight years in prison and lifetime sex-offender registration for the Aug. 4, 2014, assault at a Santa Rosa motel.

Prosecutors said the man was alone in a room with the girl when she awoke from a nap to find him molesting her.

He claimed he also had been napping in a separate bed and had no memory of the attack. The man presented testimony during a weeklong trial from an expert witness who concluded he was sleepwalking.

His lawyer argued he was not conscious and could not be liable for the offense.

Jurors returned the guilty verdict after about six hours of deliberation.

Rodriguez-Martinez will be sentenced April 21 by Judge Gary Medvigy.

Because of a jury finding that he had substantial sexual contact with the minor, he is not eligible for probation.

Or is he a natural born citizen?

Those things are never discussed in articles from this paper.

There was a case where someone was stabbed by the downtown library. Nearly all murder trials show a picture of the defendant. This one did not. same for this story. No pic of the defendant.

Doubt they had to be unanimous though, its not a murder trial.
