What do tax law experts say about Trump's claim that he can't release his tax returns during audit?

“Think of an audit as an investigation, an on-going investigation,” Goldburd said. “Any person that has legal counsel, their legal counsel will say, ‘If you’re under investigation, you should not be talking to the media, you should not be talking to anyone other than your legal counsel or through your legal counsel...‘”

But can’t he release something, we asked? Nope. “I probably would not allow him to release anything,” Goldburd said. “He’s in the middle of an investigation...”

Obama's IRS would certainly know that having Trump under audit would be useful during an election season.

Once again our government has been weaponized against it's citizens.

With all the bullets purchased by Uncle Sam, who do you think those bullets are pointed at?

Cruz claims he had no idea he was a Canadian citizen until the Dallas Morning News reported it in late 2013. Either he is being less than truthful or his lawyer skills may not be all that they have been cracked up to be. Either explanation would cover his statements on Trump’s taxes. BTW, Cruz has not released his yet either.

There is a related issue. Even though a tax audits results in a non change, the auditors can gather evidence about other taxpayers. Trump’s returns have to be full of information about other parties he does business with.

Romney and Cruz are using the “seriousness of the charge” tactic invented by the left. Disappointing. Also disappointing that Cruz chooses to collaborate with Romney. “True Conservatism” and principles are fine. But he knows where his bread is buttered.

It shouldn't Matter.
And I question your judgment and honesty in even asking the question. For the moment, that is between Trump and the Federal agencies with jurisdiction of enforcing all reporting laws.

Until someone officially becomes the Republican candidate it's no one else's business.

But this brings up an interesting observation. Mitt Romney put his size 12s in his mouth and the result could be both good for the citizenry, but devastating to future and present officeholders.

CAREFUL WHAT YOU WISH FOR!

If complete and constant disclosure of all financial and interest connections of important and significant elected and appointed office holders, and demanded by law, it would become the third rail of politics, and the rats leaving the sinking ship would be one of the most significant events in US history.

Personally, I would welcome that legal requirement, which would be devastating, if not lethal, to enterprises like the Clinton Criminal Enterprise, Inc.

The time may not come again soon for such a golden opportunity for the benefit of all American Citizens.

I know most people don’t understand about business audits but they can create legal issues beyond taxes due. I have represented business clients in the process. At the outset, the auditor asks the client numerous questions regarding each business. Each of the answers are carefully recorded. As the auditor proceeds through the audit they gather evidence to support or contradict each answer.

One of the pitfalls is lying. Lying to a federal official is illegal. It is conceivable that an innocent wrong answer could be construed as lying and raise the prospect of criminal charges.

I cannot imagine how much goes into the initial data gathering and queries for the IRS done for someone like Trump’s tax return.

To date, no one with any penalty authority anywhere has been found to answer, or even ask the question, or implement an indictment.

And if I were lead on the audit, the last thing I would want to deal with is him making public statements about anything related to the audit. In fact, I have my clients say as little as possible and remove them from the process as soon as possible. Even when they have nothing to hide, they have no idea when they are saying the wrong thing.

You’ve got it exactly.

It appears that the IRS has been instructed by the WH to audit Trump, so that Trump will have an excuse not to release his returns during the primary season. This action will prevent the “bombshell” from being discovered too soon.

Then once Trump is the GOP nominee, the IRS will give the all clear, at which point Trump will have no excuse and will be mercilessly pounded by the MSM — until the inevitable “bombshell” is finally revealed and Hilary romps to a landslide win.

All very convenient.

All he is required to release is a financial statement. He has done so. Returns are not required. I wouldn’t do it, and neither should Trump.

Which raises one of my current fantasies...

If Trump and Shrillary ever engage in debates, and the moderators ask the "Gotcha!" question, "What makes you feel more qualified to be the next president of the United tates, rather than Shrillary?

Trump would reach into his jacket pocket and pull out a thick wad of paper and watch it drop to the floor... flip flip, flip,flip flip, flip... and he would reply, "This may take way longer than 90 seconds, Ms. Megyn, but I'll give it a try..."

And, what is more likely, because it has been the Clinton (TCCEI) most used tactic to change the subject, is to watch Shrillary melt while she screeches, "I refuse to answer that gotcha question!!"

But Shrillary would fight to the death to avoid such a debate. Don't know how, but I am certain she would.

Stonewall...
Deny, Destroy, Delay has worked so well for them since the early 90s!

Anyone share that fantasy?
