The lease on Guantanamo was signed in 1903. According to the treaty, it is in effect until both sides agree to discontinue it. Cuba has protested officially and they consider it to be occupied territory.

If that research is correct, it would be a treaty. Wouldn't the US Senate have to agree to a change in the treaty?

Perhaps someone more knowledgeable can add some information.

As CIC couldn’t Obama just order the military to withdraw and abandon the post? Leave all the prisoners behind? Then the Cubans could come in and do with them as they will.

Yep, to my way of thinking the Senate would have to agree but I’m no legal guy.
