You are on the right track, but ...

I don’t want us to lose out on top notch supreme court justices because of their age, especially since a revitalized economy will resume progess in healthcare. So an age cut-off is not only arbitrary but also not forward thinking.

Presidents will always factor in age — a given.

However ....

Term limits for supreme court justices along with other reforms to negate the damage that the supreme court has caused.

Then Scalia could have retired without guilt, spent more time with his family, and written dissents at his leisure — sold them as books in fact.
