HOUSTON -- Lawyers for anti-abortion activists, including one who was a leading figure in the defeat of the city's anti-discrimination ordinance last year, on Wednesday called this week's indictments of Planned Parenthood critics legally flawed. They said they would ask the district attorney not to proceed with the case.

Mr. Woodfill and another lawyer representing Mr. Daleiden and Ms. Merritt, Terry W. Yates, called for another grand jury to look into Planned Parenthood's actions.
"We believe that this is a runaway grand jury that has acted contrary to the law," Mr. Woodfill said. "Instead of indicting the wrongdoers here, the organization trafficking in baby body parts, they've gone after the whistle-blower."

A spokesman for Devon Anderson, the district attorney, suggested her office was open to hearing the lawyers' concerns. "Just like we do with every case here, we will continue to investigate and welcome any new evidence that is brought forward," said the spokesman, Jeff McShan. "Sometimes justice is served by dismissing cases."

The DA is having second thoughts.
It's starting to look like a no-lose situation.

Think about it. If a law enforcement officer can pose as a whore and have legal clout, there is no reason a citizen, who empowers law enforcement, cannot pose as a procurer of dead baby parts.
Except that every crook they catch trying to break the law will say he was trying to expose another crook, but the cops got in the way. How is anyone held accountable? I think since they did not buy baby parts, and they released their videos, they should have a solid first amendment defense. Had they been caught before they released the info, I think their actions could be more realistically questioned.
There was a thread on here earlier about this case and it had to do with a person who worked for the DA’s office, who had some affiliation with Planned Parenthood.
THERE’S THE BIG RED FLAG. This was certainly a conflict of interest on the part of the DA’s office.
I agree that this determination was fraud. Hopefully, the Judge will demand a new Grand Jury, and the Planned Parenthood person in the DA’s office will not be allowed to participate, plus the judgment against the film-makers will be vacated. What a miscarriage of justice.

“The attorney general for the District of Columbia, Irvin Nathan, announced Friday that he will not press charges against NBC News’ David Gregory nor any employee of the broadcast network for violating the city’s gun laws. Violation of the city’s firearms laws carry a maximum $1,000 fine and one year in jail.
Mr. Nathan wrote to an attorney representing Mr. Gregory and NBC News, Lee Levine of Levine Sullivan Koch & Schulz, LLP, that, “OAG has made this determination, despite the clarity of the violation of this important law, because under all of the circumstances here a prosecution would not promote public safety in the District of Columbia nor serve the best interests of the people of the District to whom this office owes its trust.””

Who knew a grand jury empaneled to investigate one alleged crime could legally end up abandoning that issue and instead themselves indict alleged wrongdoers never charged in the first place?......

She wasn’t expressing any second thoughts on the local news tonight. She kept pointing out that she’s prolife and that the lawyer that works for PP did not work on this case. She said presenting a fake California driver’s license in Texas is a felony.
The lawyer pointed out that every kid who ever used a fake ID to buy booze would be a felon under that claim.
Wouldn’t it be funny if this runaway grand jury was prosecuted for wrongdoing at some point. I know it would be hard to prove but I think it would still be justice served.

How in the hell did they stack the grand jury deck in Texas? Did the DA corral a bunch numbskull’s from a Sunday lunch crowd at a Austin Vegan restaurant?

You make a good point. I would just say the evidence is what substantiates accountability. “You were trying to catch a crook? Whom and on what basis?”
Just as a reminder, a similar ‘runaway grand jury’ in the very same county indicted Rep. Tom Delay on bogus charges also.
