Create a crisis like ISIS, deliberately let the threat into your borders, and then pass an unlimited terrorist war powers act to take the fight to an enemy you created, no matter where they are, and for no matter how long?

The Act does not apply to the Army and Air National Guard under state authority from acting in a law enforcement capacity within its home state or in an adjacent state if invited by that state’s governor.
The Posse Comitatus Act is no barrier to federal troops providing logistical support during natural disasters. Nor does it prohibit the president from using the Army to restore order in extraordinary circumstances - even over the objection of a state governor. What it does is set a high bar for the use of federal troops in a policing role.
