Here Are President Obama's Executive Actions on Gun Control

resident Obama will officially announce new executive actions on gun control from the White House Tuesday, but released details about what to expect Monday evening. Here is a portion of what has been released, you can read the rest at WhiteHouse.gov

1. Keep guns out of the wrong hands through background checks.

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is making clear that it doesn’t matter where you conduct your business—from a store, at gun shows, or over the Internet: If you're in the business of selling firearms, you must get a license and conduct background checks.

ATF is finalizing a rule to require background checks for people trying to buy some of the most dangerous weapons and other items through a trust, corporation, or other legal entity.

Attorney General Loretta E. Lynch has sent a letter to States highlighting the importance of receiving complete criminal history.

2. Make our communities safer from gun violence.

 The Attorney General convened a call with U.S. Attorneys around the country to direct federal prosecutors to continue to focus on smart and effective enforcement of our gun laws.

The President's FY2017 budget will include funding for 200 new ATF agents and investigators to help enforce our gun laws.

 3. Increase mental health treatment and reporting to the background check system.

The Administration is proposing a new $500 million investment to increase access to mental health care.

The Social Security Administration has indicated that it will begin the rulemaking process to include information in the background check system about beneficiaries who are prohibited from possessing a firearm for mental health reasons.

 4. Shape the future of gun safety technology.

The President has directed the Departments of Defense, Justice, and Homeland Security to conduct or sponsor research into gun safety technology.

The President has also directed the departments to review the availability of smart gun technology on a regular basis, and to explore potential ways to further its use and development to more broadly improve gun safety.

If you can legally own a firearm, you can legally own an NFA registered item provided you purchase the tax stamp. Not sure what this "rule" is all about.

Not in some states, like NY. No NFA items allowed.

IDK. It may be that trusts can be used to jointly own NFA items and maybe people can be added to the trust without background checks? Seems unlikely and in any case the number of crimes committed by NFA trustees are probably close to 0.

That's true.

Ohio recently became a shall issue state with regards to NFA items. There was a tenancy of the Chief LEO to refuse to sign the form 4. It was taken out of their hands.

In California, Delaware, Washington D.C., Hawaii, Illinois, Iowa, Massachusetts, Minnesota, New Jersey, New York or Rhode Island, the state legislatures have forbidden ownership of NFA items.Seems like if California can say nobody can own an NFA item, Ohio ought to be able to say "anybody" can own an NFA item provided they are in compliance with federal laws and federal laws do not prohibit ownership and, furthermore, defer to the states.

If it is legal for you to buy a handgun, and you live in a state that allows ownership, then it is probably legal for you to own a silencer. The basic requirements are as follows:

You must be at least 21 years old

You must live in a state that allows ownership

You must not have any felony convictions

Two thoughts here.

1. If we take the shootings at face value and presume they aren't MK candidates (big if, IMO)the problem doesn't entirely seem to be access to medical care. The PROBLEM actually seems to be access to medical care and subsequent RXs for SSRIs and the like.

2. Most of these people should not be out walking around. They belong in institutions.

But yet, that same Social Security agency will not share data with the actual person holding that number when that person’s identity is stolen and when it is being used by an illegal alien.

President Trump has vowed that on his first day in office, he will revoke this EO and every other unconstitutional EO issued by Obama. It would be even better if President Trump simply revoked ALL of Obama’s EOs with Trump Presidential EO #1, and then reissued any that actually might some merit.
