It should be sent to local cops. Then let them arrest them on other than immigration charges. and jail them on other than immigration charges.

You’re exactly right. It should be handled through the Instacheck. Doing otherwise places a burden, and probably a legal nightmare, on FFL holders for something the government should do.

If Gowdy wants to do something, check on whether there are outstanding warrants for the arrest of the expired visa holders. If no,t a federal court needs to operate 24/7 until warrants are issued for all of them. That will at least enable LEOs to catch them at traffic stops, etc.

Root them out altogether——

Send the list to the US MARSHALS & have them go after them—country wide.

Send the list to ICE & assist ICE in deporting them, with a ban on returning.

Send the list to Social Security Administration & keep them from getting SS cards in the first place.

Send the list to the IRS and find those who are working illegally & who filed to get the EIC credit.

Send the list to the TSA & make sure an audit is done against the TSA employee records.

Send the list to the DHS & make sure an audit is done against those employees.

Ah, but the precedent to deny firearms access due to a misdemeanor is already set....see "domestic violence" (Lautenberg). Heck, you don't even need to be convicted of a crime, I think having a judicial "no contact" order in effect is enough to get your guns grabbed...although that might be state law and not federal.

Certainly adding those lists to the NICS should be a "no-brainer", and implemented immediately.

s demonstrably good with the deaths of those there as he played pussyfoot with her ‘asking when testifying would be good and taking MONTHS between sessions.

Wouldn’t that make life interesting.

I call in a 4473, get a proceed from the ATF and then I check the list and can’t hand out the gun.

How do I explain that when the buyer calls the ATF and demands to know why they were turned down and they weren’t.

Would that give Obama the chance to pull my FFL?

We FFL’s don’t need no stinkin lists; that should all be taken care of automatically whenever we do an Instacheck. So your stupid idea is to send us an email several times a day with updated lists and EVERY FFL is expected to MANUALLY check these lists each and every time we do a transfer?

NCIC is who any lists need to be sent to, and you should know that, Trey.

For a former DA Gowdy sure comes up with half baked ideas.

FFL’s don’t need the additional burden and RESPONSIBILTY and potential liability to posses current lists of no flys which no doubt number in the thousands.

It’s a Fed database project that should have been put into place by one of the mofo czars or something. Part of their charter.

They are the ones to have access to the raw intel reports which asses potential, possible, and could be, maybe threats. Not the FFL.

Just another effort to swamp the fire arms purchase in more moutaina of paperwork and leave them open to law suits from those unjustly placed on the no fly list. If BAFTE, DHS, et al are unable to make legal determinations how can an FFL be expected to.

A nightmare of civil rights suits would be filed by the ACLU and SPLC in lawfare attempts to bankrupt the retail sellers.

Just another feel good concern issue put out for PR purposes.

Damn, Cromwell’s plea seems more appropriate day by day. Dissolve both houses now, reset.

A judge can certainly set conditions for an accused—like not having access to weapons. And if someone has a restraining order for DV, there’s no way they should be around a gun.

Why burden gun stores with more beauracracy? The end result will be that a legit gun buyer will have to pass through one more layer of scrutiny. Any lists of foreigners in the country should be sent directly to Congress. Let Congress spend their own time wallowing through lists of the people they have allowed in.

Meaningless. As far as I know, the only non-citizens that can purchase firearms are those that have already been granted permanent resident status.

That is my understanding.

Pretty much. If you are in America illegally or on a non-immigrant visa, you cannot legally purchase guns. There are a few exceptions for people here for hunting, foreign public officials and LEOs and those with waivers from the US Attorney General.

From a practical standpoint I would think the “list” would go to the FBI and would be included in the database for NICS checks.

That said, pretty much anyone on a visa they could overstay, would be prohibited from buying firearms while the visa was valid. There are a few exceptions for people visiting here to hunt, foreign government officials and LEOs, etc.

If I remember correctly, TX recently decided that one no longer needs to have a license to have guns in their houses, or when they are traveling in their car.

Someone please correct me. If I’m wrong.
