Slippery slope here but IMO if you drive drunk and kill someone that is murder so if you flee the scene of a murder...

I am tired of the defense that DWI is not intentional/premeditated, but reckless. You chose to drink and then chose to drive, intentional in my book.

Both of the man’s hands were clearly visible and empty when the cop shoot him.Escaping the scene?The guy never made it out of the car.
Someone needs to explain to me how an unarmed drunk is a deadly threat to the officer and the public.

I assume you are reffering to the wife of the driver? If so at that point in time I wouldn’t think the officer knew she was deceased. Having said that I’d like to know exactly what led up to the chase. Not too many details at cnn.....of course.

No way. I cannot believe he reports the driver as refusing to get out and unresponsive.

I am not one for bashing cops but this one is bad and this fat butt cop needs to do some time.

I recognize this is a difficult job but they need to be able to apprehend a few of these guys and even in cases of baseball bats, knives, and other non firearm weapons, disarm at least a few of them.

That was a very bizarre shooting. I don’t see a reason for it. Fleeing the scene of a crime, in and of itself is no longer justification to shoot somebody. It hasn’t been since since Tennessee v. Garner.

In Texas, I believe the typical sentence for vehicular manslaughter involving DWI is about 20 years.

FOR THOSE WHO HAVE NOT SEEN IT:
The cop sees a car crash right in front of him.
He drives to the crash and stops.
As he gets out of the patrol car and walks towards the crashed vehicle (which is on its side) the driver tries to climb up out of the vehicle through a broken side window.
He only gets half way out.
Without a word, the cop immediately pulls out his gun and shoots him twice. The driver falls back inside.
From the time you see him attempt to climb up out of the vehicle to the time the shots are fired is less than 3 seconds. It took you longer to read this far.
Moments later the fatass murdering pig calls in saying “the driver is refusing to get out of the vehicle”
(of course you P.O.S. you just shot him... he could be dead for all you know) He made no attempt to ASK him to get out of the vehicle. He shot him when he did try to get out of the vehicle.

THE FACT THAT THEY DID NOT CHARGE HIM AFTER SEEING THE VIDEO IS WORSE THAN THE SUMMARY NEAR-EXECUTION (I think the guy is still alive)

Considering the crash that just happened - your question is silly. Not saying drunk drivers should be shot, but yes. They do pose a deadly threat. And when deadly force is the answer, then too bad for the drunk.

The threat was over after the crash,of course a drunk driver actively driving is a terrible threat.This guy got shot with his hands in the air,I don’t think deadly force was justified at that point.

I am amazed at the number of FReepers who won’t read the caption under the video, or try to get more information.

The caption under the video says the officer claims it was an accidental discharge. So yes, it was a bad shooting, but it wasn’t premeditated murder.

Unfortunately the LAW is clear on this, when HE REMOVED his gun from the Holster, INTENT WAS ESTABLISHED, An Accident is IMPOSSIBLE AT THIS POINT.

Now if it went off while it was in his holster, you would have a valid point.

I almost forgot, The Perp clearly radios in and tells dispatch that the Driver is REFUSING TO EXIT THE VEHICLE without bothering to mention that he Just MURDERED HIM IN COLD BLOOD!
