DEFEND AMERICA AGAINST ISLAMISM

Radical Islamist Terrorism has declared War against America. Many Muslims in America want to overthrow the Constitution and replace it with Sharia Law, and declare their willingness to kill you to make it happen. To ensure the continued survival of the U.S. Constitution, we must at least close the borders, declare war, prosecute Sedition, and attack radical Islam with RICO statutes.

SHARIA SUPERIOR TO THE CONSTITUTION

Sharia law presumes superiority to Constitutional Law (1, 2). A majority (51%) of American Muslims want Sharia here (4). A huge minority (33%) want Sharia to replace the Constitution (3). This is no toothless threat: Another huge minority (25%) of American Muslims approve of murdering their fellow Americans for Sharia violations (4). These facts constitute Sedition (5) in my opinion, for which all Sharia supporters should be tried, and if convicted, imprisoned for the 20-year maximum allowed by law.

Sedition in the U.S. Sedition is defined as "conspiring to … oppose by force … the execution of any law of the United States" (see below). (6) Because many U.S. Muslims support Sharia over the Constitution and violent Jihad against their fellow Americans, the full weight of U.S. law should be brought to bear against them before they further undermine the Constitution and kill more Americans

In U.S. Law, Sedition is defined as: "If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both." (4)

A full majority of 51% "agreed that “Muslims in America should have the choice of being governed according to shariah." (1) "Choice" is the key word. Sharia observant muslims propose to choose between the execution of any law of the United States and the execution of whatever law Sharia would indicate.

In the slightly more limited case of fully replacing the Constitution with Sharia, "When asked if sharia should replace the Constitution only 43 percent said no and an astounding 33 percent said yes."(3)

To understand how the scope of Sharia must replace the Constitution, consider this formulation:

"There is no separation between the religious and the political in Islam; rather Islam and Sharia constitute a comprehensive means of ordering society at every level. While it is in theory possible for an Islamic society to have different outward forms — an elective system of government, a hereditary monarchy, etc. — whatever the outward structure of the government, Sharia is the prescribed content. It is this fact that puts Sharia into conflict with forms of government based on anything other than the Quran and the Sunnah." (7).

That perspective comports perfectly well with the stated opinion of many Muslims in America: There is no room for the U.S. Constitution. Sharia must be the legal framework of society at all levels.

SHARIA CALLS FOR VIOLENT JIHAD

It is not a mistake that the respondents to the polls suggest that violence against Americans is okay. Sharia says it is okay. Let’s check.

"The Quran contains at least 109 verses that call Muslims to war with nonbelievers for the sake of Islamic rule. Some are quite graphic, with commands to chop off heads and fingers and kill infidels wherever they may be hiding. Muslims who do not join the fight are called 'hypocrites' and warned that Allah will send them to Hell if they do not join the slaughter." (8)

Further, let’s look at some correlations between support for Sharia in the U.S. and documented support for violence:

"A random survey of 100 representative mosques in the U.S. was conducted to measure the correlation between Sharia adherence and dogma calling for violence against non-believers. Of the 100 mosques surveyed, 51% had texts on site rated as severely advocating violence; 30% had texts rated as moderately advocating violence; and 19% had no violent texts at all. Mosques that presented as Sharia adherent were more likely to feature violence-positive texts on site than were their non-Sharia-adherent counterparts. In 84.5% of the mosques, the imam recommended studying violence-positive texts. The leadership at Sharia-adherent mosques was more likely to recommend that a worshipper study violence-positive texts than leadership at non-Sharia-adherent mosques. Fifty-eight percent of the mosques invited guest imams known to promote violent jihad. The leadership of mosques that featured violence-positive literature was more likely to invite guest imams who were known to promote violent jihad than was the leadership of mosques that did not feature violence-positive literature on mosque premises." (9)

So, support of violence for the spread of Sharia is both textually supported by the Quran and actually apparent in surveys of Mosques in America. This demonstrates that Muslims may well “oppose by force” the execution of U.S. Law because their Quran and imams tell them to do so.

PROSECUTE SEDITION

I believe that adherence to Sharia constitutes Sedition because Sharia specifically calls for Jihad. Jihad is historically and currently interpreted by a huge fraction of Muslim believers as violence. Arguments to the contrary are pointless in the face of actual Muslims actually committing violence that they call Jihad as they attempt to institute Sharia Law (see ISIS, Hamas, Muslim Brotherhood in Egypt, etc.)

When an American Muslim holds the belief that Sharia Law should be implemented in the U.S., and takes any action whatsoever to pursue those beliefs, those actions constitute Sedition in my opinion. For example, Muslim charity (Zakat) sent to a Mosque which has taken any political action in favor of Sharia, say supporting the institution of a local Sharia Court, is by itself a Seditious act. Supporting the institution of a contra-Constitutional law system using a political theory (Sharia) that has violent requirements (Jihad) is a death threat to the Constitution. The Constitution’s self-preservation mechanism against such threats is Sedition law.

RICO

Muslim organizations that support Sharia law should be subject to the Racketeer Influenced and Corrupt Organizations (RICO) Act. Designating such radical Muslim organizations under RICO allows prosecutors to more effectively dismantle them wholesale, rather than attempting to engage individual law breaking piecemeal. For example, the Muslim Brotherhood and CAIR in the U.S. should be so designated in my opinion. Their leadership should be jailed pending charges of Sedition as argued here. Their assets should be seized. Their membership should be liable for similar action. Their international contacts should be up on charges and disallowed from coming to the U.S. The threat of Sharia is far greater than the Mafia for which RICO was invented. Let’s use it.

CALL IT WAR

America has not yet declared war on Islam or Sharia. But a huge swath of Islam has declared war on us. We should return the favor, and after great care and consultation in Congress, the U.S. should formally declare war on something like "radical Islamic terrorism". This will allow us to abide by the rules of war rather than law when we encounter people who are at war with us. For example, the police in San Bernardino were required to address the Sharia-desiring Jihadists as if they were criminals. There may come a time when the proper response to a terror event is not a police action, but a military one. We may need to bomb a terror center on U.S. soil, much as we had armed conflict here during the Civil War. Similarly, there may be a need to hold enemy combatants for the duration of the conflict with a much lower threshold of proof than a criminal conviction beyond a reasonable doubt. Let’s declare War so that we may behave properly against this existential threat.

I propose that we declare War on some formulation like "violent Islamic terrorism" so that all the tools of war are available to us while this Fifth Column stalks our country.

INNOCENTS

Not all Muslims support Sharia Law. These are people who treat Islam as a religion, not a form of governance that should replace the U.S. Constitution. Certainly these people should enjoy all their Constitutional Rights as any other citizen who is not in open and often armed conflict with the fundamental principles of the Constitution. The trouble is, figuring out which Muslims are innocents and which are Seditionists. Until Muslims themselves help law enforcement segregate out and convict the Seditionists, law enforcement will have an unfortunate impact on the innocents. The innocents swim in the same sea as the Seditionists, and have every similar hallmark except whether they support a political position in favor of Sharia. That is unfortunate and avoidable only with their help. Western Civilization and the U.S. Constitution must maintain its ability to defend itself against existential threats. That the effort to do so may involve nasty side-effects to innocents does not mean that our civilization must commit suicide to protect the innocents’ dear feelings.

SUMMARY I'm just an average American Citizen looking at the facts I find in front of me. I see clearly with my own eyes the fact that a huge minority of Muslims in America want us dead and our law and culture replaced by their own. Our law and culture have self-preservation mechanisms available to us. Close the borders. Declare War. Prosecute Sedition. Attack radical Islam with RICO statutes. For the love of America, DEFEND HER ALREADY!

Good point. I think my Title accidentally glanced into the proper formulation:

That’s a political ideology of superiority.

Islam the religion, if it called for the separation of mosque and State (which it essentially is unable to at this point in history) would be far less of a threat. Possibly even manageable within Western Civilization.

But we won’t find out in our lifetimes....
