An 11-year-old South Florida student was handcuffed and arrested, charged with aggravated assault, after he hit another student with a toy gun.
According to Miami-Dade Schools Police, a student at Edison Park K-8 Center in Miami assaulted a classmate off campus on Tuesday with what they initially thought was a gun.
The parents of another child witnessed the fight and came to the school to report the incident to school officials, Wednesday morning. Miami Schools Police responded, located the student, and officials were able to search his bag, where they located the novelty item.
Since the incident occurred off school property, City of Miami Police arrived to investigate. "Lots of times, people don't think that toy guns are actually dangerous, and in reality, they are," said Miami Police Officer Kenia Fallat. "Toy guns can be misconstrued for actual guns."
7News cameras captured a Miami Police officer escorting the handcuffed student off school property. A woman in a purple blouse was seen pushing a stroller next to the child. He was transported to the Miami Police North Station, where the woman in purple was also seen and declined to comment on the 11-year-old's arrest.
Another student told 7News he was walking home from school when he saw the incident. "I see the kid, he's holding on to the other kid, and he hit him and ran off," said Issac Essix.
Per police, any person arrested must be placed in handcuffs no matter the age. "The department's policy is, if you commit a crime and you are being arrested, you are going to be handcuffed," said Fallat.
The mother of the victim was also called. She arrived at school and wanted to press charges against the student.
A concerned parent at the school told 7News these incidents are often the results of parental negligence. "Parents need to get involved when things happen with their kids instead of taking the kid to the side and saying, 'Somebody hit you. Do this or do that,'" said Emmanuel Alcime. "There's a proper channel to go through with the proper authorities and let them deal with the situation so it doesn't escalate."
Miami Police released the arrest report Wednesday afternoon. It read in part, "The defendant approached and grabbed the victim by the shirt. The defendant ordered the victim to say 'rest in peace.' When the victim refused, the defendant struck the victim in the face with a black plastic pellet gun. The defendant then told the victim if he told his parents he would attack him at school the next day."
"That's why parents are supposed to check their kids, because you can assume your kid is doing right, but when your kid is not around you, then what is he exposed to?" said Alcime.
According to officials, the student will be charged with aggravated battery and aggravated assault. He is being held at the Juvenile Assessment Center.

Sorry parent but you take your kids little dust up to the cops (proper authority) and you have just escalated the matter out of your control and you may have just unnecessarily ruined a kids life.

Not only did i not press charges (fought the instigator one on one at a later date), I would have DIED if she had found me.

Our daughter, who is a teacher, was involved in a similar story a year ago, and reality did not match the media hype of her situation.

There were school yard fights between boys IMO just part of growing. Back in the day they never involved weapons in my area. A few punches some rolling around on the ground done.

Actually...they are handcuffed because if the person does anything to injure themselves while in police custody...including injuring himself on purpose...the officer gets sued for failing to keep the person safe...including from himself.
