Judge rejects latest stay request from Kentucky clerk Davis

A federal judge on Wednesday denied Kim Davis a stay of his order requiring her office to issue marriage licenses to all eligible couples who want one, the latest setback for the Kentucky county clerk who went to jail rather than issue licenses to gay couples.

Lawyers for couples suing Davis have said that since her return to work, the Rowan County clerk has interfered with the issuance of marriage licenses in violation of orders by U.S. District Judge David Bunning's in Louisville.

An attorney for Davis has said she has made a good-faith effort to comply with Bunning's orders. She has said licenses granted by her staff are invalid because she has not given them that authority.

Print new forms without her name on them. This is not difficult. Send them to Justice Kennedy to sign. He is the one that wanted them.

Tell the SOB judge she has no authority under current Kentucky Law to issue any licenses. The law was stricken by the SCOTUS.

The only legal argument Davis and her attorneys ever needed to make in this case was the following: "If it's so important in the eyes of this Federal court for the two plaintiffs in this case to have a valid Kentucky marriage license, your Honor, then you sign it." The judge's refusal to sign the marriage licenses would be an acknowledgement that he had no authority to do so, which would also be an explicit acknowledgement that a Federal court had no say in the matter.

What we have here is

US Supreme Court made a law.
Judicial branch acted as legislative branch.

Federal court is enforcing the legislation.
Judicial branch acting as executive branch.

Clearly, the judicial branch is usurping its authority by assuming the role of the other two branches.

The answer issimple, I’m sorry your Honor, butthereis no current valid Law in the State of Kentucky granting me or anyone else in the State any Marriage License, the USSC Struck it down, remember. They did not WRITE A NEW LAW, they simply voided the old one.

Then go file formal Kidnapping charges against the Judge.

That legal argument is exactly what a Tennessee judge said a few weeks ago when he threw out a divorce case that had been brought before him. He basically said: “In the aftermath of the U.S. Supreme Court decision in the Obergefell case I can’t make a ruling in this divorce case — because I don’t even know if the couple before me is even legally married under the law.”

Kentucky Gov. Steve Beshear is the one at fault for not accommodating her religious beliefs as he is required to do under state law, says Kent Ostrander, executive director of The Family Foundation of Kentucky.

“Kim Davis did not go to jail for what she did. She went to jail because of what Gov. Beshear did not do,” he stated.
