Ex-State Dept. Staffer Who Set Up Clinton Home Server to Take 5th Amendment Before Congress

The Washington Post reported Wednesday night that a former Hillary Clinton State Department staffer who reportedly set up her home brew server will invoke his Fifth Amendment rights and refuse to testify to Congressional committees investigating Clinton’s home email system.

Bryan Pagliano, though his attorney, informed the House Benghazi Select Committee which had subpoenaed him to testify on September 10, that he was declining to testify. The Post reported the letter cited the FBI investigation in to Clinton’s email system. Senate committees seeking Pagliano’s testimony were also informed he would be taking the Fifth.

““While we understand that Mr. Pagliano’s response to this subpoena may be controversial in the current political environment, we hope that the members of the Select Committee will respect our client’s right to invoke the protections of the Constitution,” his attorney, Mark MacDougall, wrote.

Some documents have also been manipulated. Their classified markings have been removed or changed, which would explain why she has changed her public statements about what was in her possession — and when. Initially she claimed unequivocally that there “was no classified material.” She now says, “The facts are I did not send nor did I receive material marked classified.”

This appears to be the basis for her defense: that some of the documents’ classified markings were removed or changed — without permission — before she saw them.

By whom? There are only three people who were close enough to her to have had that kind of access: Chief of Staff Cheryl Mills, Deputy Chief of Staff Jacob Sullivan, and her longtime Gal Friday, Huma Abedin.

Ms. Mills, Mrs. Clinton’s Valerie Jarrett and shadowy hatchet gal, is a lawyer, which may present evidentiary issues for the government as much of her communication with Mrs. Clinton may be privileged.

Ms. Abedin, who has had her own issues involving her husband, former Rep. Anthony Weiner, her family’s alleged ties to the Muslim Brotherhood, and her extracurricular employment activities while at State, is not a lawyer and may be more exposed. She lawyered up recently, but like Ms. Mills, she knows too much about the Clinton Foundation and Bill Clinton operations and how they mixed with Mrs. Clinton’s State Department (and server) to be sacrificed.

This leaves Mr. Sullivan, the outsider. If it’s true that he is cooperating with the FBI, Mrs. Clinton may try to smear him as a John Dean-style rogue, who either didn’t alert her to unmarked classified material or removed the markings himself and is now trying to save his own hide.

I once had an adverse witness who took the 5th.

After he did so a few times to pertinent questions, I started backing away from pertinent questions into more general questions, such as what was the weather on the day in question. Each question was just a little less incriminating than the last, but never enough to let him feel he could answer it and not the one just before.

My final question to him was, “See the second juror in the first row there, the sweet lady in the lovely dress. Is it a blue dress? He wouldn't answer.

I threw up my hands, gave the jury my best “I'm only trying to get you the information” look, and sat down

Other side objected repeatedly, but I got the witness declared hostile and judge was pizzed at him and the lawyer other too, so she let me keep going.

When it was all over, jury was ready to hang him, and the bad guy he was supposedly a witness for.

Lesson here. Ever so politely ask him question after question. 100 times. Make him look like a fool and a crook and he takes Hillary with him!!! and it's great TV.

Just a thought
Remembering all the Chicago investigations.
Once the FBI was called in there were quite a few (reluctant witnesses) who wore wires or willingly had their phones tapped.
We can dream!

Yep, just like the IRS being questioned about releasing taxpayers’ records to the White House, but refusing to cooperate by saying that disclosure of such information might compromise the duty of confidentiality owed to tax payers.

Whichever Justice dept. atty came up with this deserves the Orwell Decade Award.
