The State Department said Monday afternoon that when it releases the latest tranche of Hillary Clinton's emails tonight, 'somewhere around 150' of them will have been 'upgraded to classified' status.

Agency spokesman Mark Toner briefed reporters in advance of the periodic release, which was rescheduled twice during the day and is now expected at 9:00 p.m. EDT.

Under intense questioning, Toner conceded that the review of about 7,000 pages of emails in the latest batch has uncovered the 150 communications 'that have been subsequently upgraded classified.'

He emphasized that 'the information we've upgraded was not marked classified at the time the emails were sent.' But Toner seemed to hedge his bets against future decision-making inside the U.S. Intelligence Community.

'That's our estimation right now,' said Toner.

I think this is misleading. Perhaps intentionally so.

Previous disclosures indicated that the texts of these emails were classified at the time they were sent; but someone had stripped off the words, "Confidential, Secret, Top Secret", etc.

Simply removing the heading does not declassify the document. Plus; Hillary, as Secretary of State, did not have the authority to declassify documents.

It is still a crime, whether it's marked or not to put classified info on an unclassified network. And, taking the classification off is yet another crime. So for every classified attachment or message not marked classified should be yet another crime.

More of the FALSE meme that the emails were not classified at the time. At the moment of creation, sensitive and classified information is classified. It can be later down graded, but I have never seen it upgraded from non-classified to classified. And I have seen and handled a lot of classified material.

I might be confused but it seems to me that a more appropriate response would have been to reference ‘were received’ and not ‘sent’. Perhaps between some persons time is instantaneous.

You have to parse the words of a Clinton very carefully. She's said repeatedly that the emails were not "marked classified". In strict parsing, that's probably true. It's been probably 20 years, but the classified documents that I remember handling were marked, "Confidential", "Secret", or "Top Secret", but not MARKED with the word "Classified".

That’s exactly what Judge Napolitano said a couple weeks ago on Fox. The docs are never marked “Classified”; other words are used. She using typical Clinton bafflegab to lie. It’s like when Bill said he “did not have sex with that woman, Miss Lewinsky, not a SINGLE time”. He was telling the technical truth. He didn’t do it a SINGLE time; it was many times. They are so f*king sneaky.

My husband just retired from a missile defense contractor. He listed the actual verbiage used on classified government documents, emails, etc. Never the actual word, “classified”.
