IRS Commissioner John Koskinen could counter-sue on the basis that the taxpayers are the ones who sent the data to the IRS in spite of the fact that it is a known incompetent agency.

He’d probably win!

The Internal Revenue Service must answer in court for a data breach in which hackers gained access to personal identifying data belonging to at least 330,000 people.

And their answer will be...
