Case of illegal immigrant facing sixth deportation from Michigan not unusual

PONTIAC, MI -- The case of 30-year-old Rogelio Peralta-Espino, who was born in Mexico but repeatedly returns to the U.S. illegally, highlights the cat-and-mouse relationship between immigration officials and those intent on staying in America.

Peralta-Espino's situation, his repeated illegal reentry into the U.S. after being returned to his native country, is not an anomaly. Immigration and Customes Enforcement agents arrested Peralta-Espino in Pontiac Tuesday. He is now facing his sixth deportation.

With 26 percent of all federal cases prosecuted in 2013 being for illegal reentry according to the U.S. Sentencing Commission, Peralta-Espino, and tens of thousands of others like him, become a huge burden on law enforcement and judicial resources.

Peralta-Espino has no record of committing a violent crime, but has nevertheless had numerous interactions with police, U.S. Border Patrol, Immigration and Customs Enforcement and various judicial jurisdictions.

His convictions not related to illegally residing in the U.S. are for possession of marijuana in 2006; obstructing and resisting a police officer in 2013 and driving without a license in 2013.

Because of he has three or more prior convictions, he could face up to 10 years in prison for his latest illegal reentry violation.

This is what some of us were trying to avoid since about 1995.

Nobody wanted to listen back then, even here as late as around 2000.

Today, it’s a very serious situation.

It didn’t have to be this way.

Start deporting them to Tierra del Fuego and see how long it takes them to again enter the US illegally.

Out betters tell us that the punishment should fit the crime. Too often, it is just a slap on the wrist. For most people, it makes the crime worth the risk.

If the punishment was more severe, a lot of people would think twice before committing a crime.

Example - cross the border illegally? 5 years hard time in prison. Do it a second time, then it’s 25 years. Oh, and by the way...you family will be responsible for feeding you while you are incarcerated.

This case has always stuck in my head. I guess it was because it happened the same weekend 4 young children were killed by an Illegal in Minnesota.

These illegal colonizers need to not want to come here.
1st offense - Simple deportation
2nd offense - 3 years in prison followed by deportation
3rd offense - 10 years in prison at hard labor followed by deportation
4th offense - sentenced to slavery and sold in the Middle East
(Thirteenth Amendment - Section 1. Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.
