Illegal immigrant parents and children should usually be released rather than held in custody, a federal judge ruled late Friday in a decision that could put thousands more illegal immigrants out on the streets, where they’re less likely to return for their deportation hearings.
The sweeping decision, by U.S. District Judge Dolly M. Gee, gives the Obama administration 90 days to object, but otherwise she said she’ll order that the government quickly move to release all illegal immigrant children and try to release their parents as well.
Judge McGee also ruled that the facilities Homeland Security set up to house the illegal immigrant mothers and children that streamed across the border during last year’s surge violate a 1997 agreement, and cannot be used.
All of those rulings are major blows to President Obama and Homeland Security officials, who had used family detention as a key measure in stopping the surge. Now the administration must either figure a way to fight the order, or else come up with a new strategy.
Judge McGee cited “widespread and deplorable conditions” in the detention centers, which she said included cold cells, lack of trash cans, and keeping lights on at all times, potentially disrupting sleep patterns.
“In light of the voluminous evidence that Plaintiffs have presented of the egregious conditions of the holding cells, the court finds that defendants have materially breached the Agreement’s term that defendants provide ‘safe and sanitary’ holding cells for class members while they are in temporary custody,” Judge McGee said.

When they reach adulthood that can assert what little claim they may have to US citizenship*, right now all they get is exactly what an American child born elsewhere would get, a certificate of (parent's nation's name) citizen born abroad.
*allowing for the possible eventual recognition that accident of birth citizenship was never the intent of the 14th Amendment.
