Alabama attorney files lawsuit against Gov. Bentley challenging Confederate flag removal

A Cullman-based attorney has filed a lawsuit against Alabama's governor saying Robert Bentley didn't have the authority to remove Confederate flags from the grounds of the state Capitol.

The lawsuit states the Alabama Historical Commission didn't follow its mandate and the governor "overstepped his authority" when four Confederate flags were removed from the Confederate Memorial Monument on June 24.

Melvin Hasting filed the suit on behalf of himself in Montgomery County Circuit Court on Tuesday afternoon. The suit lists Bentley, Alabama Historical Commission and its acting executive director Lisa Jones as defendants.

Hasting is asking the court for a preliminary injunction to settle the question over the powers of the Historical Commission and the governor. He also asks that the Confederate flags be returned to the monument in their original condition.

Hasting "is an aggrieved citizen of the state of Alabama and is entitled to bring this action to declare the rights of the defendants to unilaterally and unlawfully alter the historical and heritage significance of objects, buildings, monuments and landmarks from the Confederacy era," the suit states.

According to Alabama code, the Historical commission is charged with the duty to: "promote and increase knowledge and understanding of the history of this State from the earliest time to the present, including the archaeological, Indian, Spanish, British, French, colonial, Confederate and American eras."

Following this order, Hasting claims the flags shouldn't have been removed.

Hasting also noted in the suit that the Alabama State Capitol is on the National Registry of Historic Places.

On the day the Confederate flags were removed, Bentley told AL.com it was the "right thing to do.

Enough ethnic cleansing. I have said as long as there is one with my name buried at Gettysburg I would not own or fly that flag. Today I feel like putting one on my truck and going out trolling.

How can they separate a flag, symbolic of what the memorial recognizes, from the memorial itself? Next they will, and in some cases already want, to remove the memorial too. We have to stand up, not for past errors, but for history. To eradicate memorials to those who sacrificed in the name of states right, would be the same as saying slavery never existed.

Free Speech is being destroyed in this country through Political Correctness and such things as misinterpreting anything and everything to do with our culture and heritage as a people.It is beyond disgusting how many people fall under the Nazi tactics so easily, and throw away their God Given Rights without a backward glance.

My great-great grandfather was a Confederate soldier & fought at Shiloh. It is just beyond asinine the histrionics the left is raising. - I can see not having Rebel flags flying over government buildings; but removing them over CONFEDERATE MONUMENTS is knee-jerk. - This is supposed to be a FREE country.

I agree about the left’s histrionics. If the Confederacy is part of the history of a state, why not fly that flag over government buildings which were, and are, paid for by southern sympathizers and descendents of Confederate soldiers as much as by “Yankees” and their supporters.
It is the misrepresentation of history in the form of outright lies by the left that disturbs me the most. Abraham Lincoln made the War of Northern Aggression all about slavery as a war tactic when the South was winning. January, 1863 he issued the Emancipation Proclamation which DID NOT free the slaves in the north. He desired the submission of the south because the north couldn’t stand the loss of taxes and other revenues they received from the south. The war was NOT fought over slavery, but over the States Rights to govern themselves. NOW, we are fighting over Articles of the Constitution which the left wants to destroy. FREE SPEECH, Freedom of Religion, the RIGHT to keep and bear arms, the Right to not be deprived of ones possessions without DUE PROCESS, etc. etc. etc. And ALL the hoopla over the Confederate States and particularly over the ARMY of Northern Virginia’s Battle Flag is designed to INCREASE RACIAL TENSION and BUY VOTES from the uninformed....or i should say, MISINFORMED. You’re right, this is SUPPOSED to be a FREE Country, but it isn’t any longer.
