Sucks, but that is the way our system works. That actually makes it worse though politically, the guy has nothing they can sue for....if he has anything in Mexico I suspect the family would have to go down there to sue.

Not really. In legal parlance, the city constituted an 'attractive nuisance', where something like this was bound to happen eventually.

Suing in Mexico against a local by a gringo has as much success as finding snow on the sun. We cannot get them to even extradite for capital murder facing death or life.

She might get a settlement nonetheless, seeing as how political this case is apt to become. I agree with you that a judge would dismiss the case before trial on grounds of no duty to an individual member of the public, and/or immunity.
