If they are not recoverable then that would be a destruction of evidence situation. But that felony won’t be prosecuted.
IMO.. this will go nowhere.. they have the DOJ in their pocket.
In a real world you get the tech in there and threaten him with jail time unless he gives the name of who it was who gave the order ... then you just start chimbimbing up the chain
