A court ruling striking down a Pennsylvania law that made it easier for gun-rights advocates like the National Rifle Association to challenge local gun ordinances is drawing strong reaction from both sides of the issue.
A spokesman for Philadelphia Mayor Michael Nutter says Thursday’s Commonwealth Court ruling that the law is unconstitutional will allow municipalities to pursue common-sense gun safety requirements.
Sen. Daylin Leach is one of five Democrats who joined in the challenge of the law. He says municipalities that repealed their gun ordinances because of the law can now restore them.
An attorney for four pro-gun groups dismisses the ruling as a bump in the road. He predicts that the fight against what he described as illegal local gun ordinances will continue in the courts or the Legislature. …

I wonder if the Judges know about this section in the Pennsylvania Constitution:
Section 21.
The right of the citizens to bear arms in defense of themselves and the State shall not be questioned.
What part of “Shall not be questioned” do they not understand?
Evidently it’s the same part of the Second Amendment that the USSC fails to understand, “shall not be infringed”.
I think it must hinge on the word "and." Maybe, in the opinion of the Court, the only people not permitted to be questioned are those in the PA National Guard, as they would be the only ones who can satisfy BOTH conditions.

Sounds like the retarded media’s attempt at describing a Pennsylvania version of preemption. Kind of like describing things based on their feared outcome. “Doggy ass bite” would be my word for an annoying kid striking the fence posts with a stick at “Killer’s” house before he realizes the gate is open.
I don’t want to wade through the legal opinion, but I wonder why state preemption would be unconstitutional in Pennsylvania? Is it because Philly rules the state?
We have it here in commie Washington state, and the state supreme court still gave (commier?) Seattle a royal smackdown due to firearms preemption.
State law trumps local law. It seems a fairly well established principle.
If I were a gun-grabbing mayor, I wouldn't take much comfort from that. Next time Pennsylvania has a Republican governor, it is likely to become law.
It’s become quite clear in light of the SCOTUS decision upholding ObamaCare that Leftists are not required to affirm the law, obey the law, or even speak English.
They simply do whatever the h*ll they want, and rely on corrupt, Soviet-style courts to uphold their actions.

Careful... The SCOTUS just redefined the word “State”.
It is a pillar of “progressive” legal theory that the Constitution means only what the Supreme Court says it means, nothing more.
Of course, leftists activist add the proviso that if the Court disagrees with them, its findings are illegitimate.
