Law Professor: Freddie Gray Autopsy Is ‘Very, Very Helpful To The Defense’

The autopsy conducted on Freddie Gray helps the case of the six Baltimore police officers charged in the 25-year-old’s death, a law professor tells The Daily Caller.

John Banzhaf, a law professor at George Washington University, also says that the autopsy, a review of which was published Tuesday by The Baltimore Sun, indicates that Baltimore city state’s attorney Marilyn Mosby “downplayed” the medical examiner’s findings when she publicly announced charges against the officers on May 1.

“I think this autopsy report is very, very helpful to the defense in many ways,” Banzhaf told The Daily Caller in a phone interview.

“The report suggests that Gray may have contributed to his own death.”

According to Banzhaf, the possibility that Gray stood up on his own before the injury presented “a new and unexpected danger” for police — one that they “could not have reasonably anticipated.”

“This finding that Gray probably caused harm to himself by standing up … weakens the argument that any cop’s conduct was reckless or grossly negligent. This is not something that somebody could reasonably foresee.”

Banzhaf ... also said that the autopsy indicates that it will be “very, very hard” for prosecutors to prove that the officers had the state of mind required to match the charges.

The fact that opiates were found in Gray’s system won’t help the prosecution much either.

The way that they were over-charged then yeah, the autopsy is a big help to the defense. It doesn't change the fact that the man is dead because the police did not follow their procedures and, if recent stories in the Baltimore papers are any indication, may have helped his injuries along a bit. So they may well be exonerated on the murder charges, as they should be. And they may well walk on the other charges, because of prosecutorial incompetence. But that doesn't make them innocent of all wrong-doing.

Gray suffered that injury after the officer driving his police transport van, Caesar Goodson, Jr., had placed him in leg shackles and put him on his stomach in the vehicle.

I think it is possible that Goodson could be found guilty of negligence for failing to properly secure Gray. None of the other officers have any responsibility.

The biggest problem is that Goodson is black, which totally destroys the narrative.

She probably over-charged them. It seems like there could be a lesser charge if they were supposed to bound him to the seat. Seems like there could also be a lawsuit on behalf of the family. Just sayin’.

The autopsy says that the injury occurred before that guy was picked up, and place into the other side of the dividing wall in the van.

That is why I think that Goodson could be found guilty of negligence.

I don’t see how any of the other officers that were charged are liable, certainly not for murder or conspiracy.
