ABORTION RULING Toledo clinic to remain open Judge: State law unconstitutional

Finding that the state had “exceeded its constitutional authority,” a Lucas County judge ruled Friday that Toledo’s only remaining abortion clinic may keep its doors open.

Common Pleas Judge Myron Duhart found that Capital Care Network may continue to operate its West Toledo clinic, concluding that Ohio’s law requiring abortion clinics to have transfer agreements with “local” hospitals was unconstitutional.

The 30-page ruling, which reversed a previous decision by the Ohio Department of Health to close the clinic, was hailed as a victory by abortion-rights advocates and attorneys for Capital Care.

“They’re open for business. They’re licensed, and they have a transfer agreement,” Cincinnati attorney Jennifer Branch said of Capital Care’s West Sylvania Avenue clinic. “They’re good to go. The women in Toledo have a choice now. Without Capital Care, the women in Toledo are left with driving to Michigan, Cleveland, or Columbus.”

Dan Tierney, a spokesman for Ohio Attorney General Mike DeWine, said Judge Duhart’s decision would be appealed to the Ohio 6th District Court of Appeals. Mr. DeWine did not have additional comments on the ruling, he said.

Forgive my ignorance but what is a transfer agreement? Does it have something to do with if something goes wrong at the murder mill abortion clinic, then the victim has to be transported to a hospital?

Pretty much. As opposed to calling an ambulance and pushing her out onto the street.

Under Ohio law, ambulatory surgical centers (which include abortion mills) must have a doctor on staff who has admission privileges with a local hospital. Many abortionists do not have such privileges. When that is the case, abortionists have found doctors who will “substitute” for them should an abortion participant need hospital care. This results in a variance if approved by the Ohio Department of Health.
