The leader of the Dallas County Bandidos motorcycle gang opened fire on rival bikers at a shootout in Waco last month, police claim in newly-released court documents.
David Martinez, 45, pulled out a 32-caliber pistol, started shooting, and then hid the weapon in the back of someone else's car, police said. A search of his motorcycle later found a Glock 40-caliber handgun with a box of bullets, police said.
Martinez is charged with engaging in organized criminal activity and was released from jail on $1 million bond.
Even though the court records claim Martinez led the Dallas County Bandidos, jail records show he is from Terrell, which is in Kaufman County.
Martinez could not be reached for comment. The allegations came in court documents which police filed to seize Martinez's motorcycle and 26 other vehicles.
The same court documents outline months of growing squabbles between the Bandidos and the Cossacks.
A police detective detailed six violent incidents in the months leading to the shootout in Abilene, Palo Pinto County, Waco and nearby Lorena involving the two biker groups.
NBC 5 previously reported on a fatal shooting at a Fort Worth bar which also was linked to the two gangs.
The Bandidos were angry at the Cossacks for wearing a Texas insignia on their jackets and planned a meeting with other biker groups in Waco, police said.
The Cossacks were not invited but showed up anyway, taking over parts of the Twin Peaks restaurant and lining the parking lot with sentries, or lookouts, police said.
"Cossacks threatened that Waco was a 'Cossacks' town' and nobody else could ride there," the investigator wrote. "The large number of Bandidos and their supporters showed up because the Bandidos wanted to have a show of force and make a statement that Waco was not the Cossacks' 'town.'"
A Bandido ran over the foot of a rival biker and the tensions quickly escalated, police said.
"Several of the Cossacks pulled their weapons, including handguns, as they stood on the patio and exited the patio," the detective wrote. "Several Bandidos and Cossacks pulled out guns and knives and shot and stabbed each other."
Officers recovered 480 weapons and detained 239 people. Of them, 177 were arrested. Many have since been released on bond.
The affidavit claims that Waco Police were fired upon during the altercation.
Good thing it was only a box of bullets, and not cartridges...

Hilarious. When I suggested that this very statute, on organized criminal activity, might be used in the indictments to justify the arrests of seeming “bystanders”, I had a bunch of incredulous replies, but lo an behold!
Also this seems to undermine the whole “it was a meeting about helmet laws” scenario many have been pushing.

You need to skip past the article and read the the actual affidavit to get the “real” story.
I was only making a comment about the reporter’s lack of technical acumen, not about whether or not the guy had a bunch of ammo. I don’t really care, to be honest. I just get irritated by retarded reporters.
For now we’ve got to take the affidavit with a grain of salt. According to the AP’s review of the security tape and Waco PD’s chronology of events, from the time the fight started until nine were dead and the Waco PD was inside Twin Peaks was about two minutes.
Well, the PD were already there, so I’m sure they responded immediately when they heard gunfire in the parking lot.
Read the affidavit. The reporter is parroting what the Waco PD investigator put into the affidavit on page nine. Maybe the Bandido collects bullets. Maybe there are inaccuracies in the affidavit. I’m betting on “inaccuracies.”
The PD responded when they were fired upon by the brawlers. It’s in the affidavit.
Well, you can’t expect a police officer to know squat about firearms—hell, they can’t even use them correctly! Cops are some of the worst shots out there.

I wouldn't take it with a grain of salt. It's actually consistent with the witness accounts. It just appears to leave out some things:
The violent altercation continued until the Waco Police Department & other members of law enforcement were able to stop the violence and take control of the scene.
There's nothing about how they did so.
As you noted, it makes a claim earlier in the affidavit that police were "fired upon" during the altercation. There are also descriptions of things observed in surveillance and dashcam video, which gives some clues about what may be in evidence during the upcoming trials.
One of the statements on page nine is that Martinez was observed on video, shooting a handgun while standing behind a Suburban with a certain license number, then placing "an object" into the vehicle. They later found a .32 Beretta in the vehicle.
That's pretty specific.
So how many were shot with .223s vs. handgun calibers?
So he had a .32 gun in his pocket for fun. Did he have a razor in his shoe?
Or am I thinking of Leroy Brown?
Where do you get that? An argument in a parking lot leading to violence has nothing to do with the purpose of the meeting.
