Suit challenges South Carolina tuition rules [instate tuition for illegals]

"......Attorney Michelle Lapointe with the Southern Poverty Law Center said Tuesday the regulations often make it impossible for talented, high-achieving citizens to afford college, as the out-of-state rate can be triple the cost of in-state tuition. Non-residents also cannot receive lottery-backed state scholarships, need-based grants or tuition assistance."

Children Of Illegal Immigrants Sue For In-State Tuition In South Carolina

"A class action lawsuit filed this week in federal court by the Southern Poverty Law Center and Appleseed Legal Justice Center charges that policies classifying the children of illegal immigrants born in the U.S. and living in South Carolina as “non-residents” for the purposes of tuition, grants, and scholarships are discriminatory.

“This class action lawsuit challenges the policies of the South Carolina Commission on Higher Education (‘CHE’), the College of Charleston, and Trident Technical College that classify dependent U.S. citizen students who reside in South Carolina as ‘non- residents’ for tuition, scholarship, and need-based grant purposes solely because their parents lack requisite proof of citizenship or immigration status,” the lawsuit reads.

“These policies invidiously discriminate against Plaintiffs and other students who are U.S. citizens, in violation of the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution,” it adds.

The suit was filed on behalf of three teens who argue that, despite the inability of their parents to prove they are in the country legally, they should be granted in-state benefits to pay for college in South Carolina.

The plaintiffs are suing as part of a class."

January 3, 2011 - Walker assumes Office of Governor of Wisconsin.

June 27, 2011: Walker Revokes In-state Tuition For Undocumented Students Attending Univ And Colleges In Wisconsin "- On Sunday, Wisconsin Governor Scott Walker (R) signed his two-year 2011-2013 budget, which included ending in-state tuition for undocumented students attending public universities and colleges. In-state tuition for undocumented students was approved two years ago by former Governor Jim Doyle (D) after the Hispanic community struggled for 10 years to pass it."...

Wisconsin is the ONLY state to EVER do so.

Obama went for free claiming to be from Kenya. Why don’t the illegals just do what he did? Or they can move to Arkansas and go cheap there..

This is apples and oranges...

The lawsuit in South Carolina is about denying in-state tuition on the basis of parental citizenship.

The law repealed in Wisconsin is about denying in-state tuition on the basis of the students citizenship, i.e., the lack of U.S. citizenship.

The SC suit will probably succeed. The larger problem being ignored is why we give citizenship to the children of illegal aliens. It’s never been adjudicated - the federal government simply decided to start calling them citizens if they have a U.S. birth certificate. Every attempt in Congress to change that has been tabled.

It makes no sense that the illegal alien parents are the ones who decide who will be a citizen. We should, not them.

But until that happens, the SC lawsuit will probably win.

That said, have we ever seen the ACLU sue a state that gives in-state tuition to illegals - such as Texas was up until recently - on behalf of American citizen children who want to go to school in that state without paying non-resident tuition?

No. Of course not. The ACLU doesn’t give a damn about Americans, their job is to undermine the U.S. in any way possible.

Originally, parental rights were property rights. Parents “owned” kids. Then they transitioned to responsibility rights. A child was the parent’s responsibility and was thus claimed on the parent’s taxes. If the ACLU is claiming the parents have no rights then they have no responsibility and can’t be claimed on income taxes. Nor can the parents be required to maintain health insurance until the age of 26 as required by Obamacare.

Hypocrisy and lack of consistency with principal is the common thread of all the Leftist arguments.

Everything they argue relies on Ad Hoc theories that ignore or speciously invoke common principles, setting up contradictions within the law.

Strained legal theories are the basis of Leftist common law initiatives.
