Just issue a pardon and go on. We all know this is bogus!! Where does Tom Delay get his defense money back?
If this is another Delay situation, the Gov. needs to deal with the prosecutor, perhaps through his Solicitor General.
Not sure a pardon can be issued since no conviction has occurred, but he should be able to get the charges dismissed.
