For those who might be interested in a transcript of yesterday's oral argument on same sex marriage.

Justice Kennedy is effectively king of America as laws and customs are determined by his edict.
Yup. Pretty much.
The pessimistic side says it doesn’t matter because Roberts is determined to be a “significant” Chief Justice by changing everything he can, and Kennedy will join him.
MS. BONAUTO: The Michigan — the Michigan
9 statute and amendment certainly went out of their way to
10 say that gay people were in some sense antithetical to
11 the good of society. They wrote that —

13 your brief that the primary purpose of that was to
14 demean gay people?
15 MS. BONAUTO: I think it has that effect,

Really? And does their amendment demean pedophiles, and people who practice bestiality, and incest, and and and too? No? and why is it that all these lifestyle choices that the the amendment bans from marriage are not demeaned, yet you single out gay people and claim they are being demeaned simply because they aren’t allowed to marry? It seems to me Mr Bonauto that Michigan and every state that bans marriages or certain people who commit unnatural acts, are not infacvt singling anyone one group out, but rather are singling out the concept of DEVIANT sexual practices of all stripes and saying that it is immoral, and therefore under law, it is not allowed-
Can you Mr Bonauto explain to the court why all of a sudden just the DEVIANT practice of gay sex is not immoral when it has been immoral for a millennia? And why it’s now not immoral but the other immoral practices are still immoral?
Societies have deemed, since the beginning of time, unnatural sexual acts and certain couplings as immoral, and the majority of people to this day still believe the act of gay sex is immoral, and you want this court to pander to an extreme minority of people simply because they want to practice their immoral behavior AND have all the benefits of marriage as a reward?
MS. BONAUTO: I don’t know what other
13 societies assumed, but I do believe that times can blind
14 and it takes time to see stereotypes and to see the
15 common humanity of people who had once been ignored or
16 excluded. And I do believe —
So Mr Bonauto- you are claiming that only gay people are ‘ignored’ an ‘excluded’? It seems ot me that ALL practicioners of ALL deviant sex have been excluded for a reason- Here, let me spell it out for you... They were excluded because what they do is I m m o r a l, and you have provided this court with NO reason why it shouldn’t be considered immoral- the best you can come up with is “Ancient people were mean because they didn’t recognize gay marriage’ and frankly sir, that has been the whole crux of your argument for hours now- you’ve spoken a great deal of words sir, but you have not provided this court with a valid reason why gay sex should be taken off the immoral list, while the other DEVIANT sexual practices should remain on the list. You are asking this court to arbitrarily legislate from the bench by declaring a previously declared immoral action is now moral, despite having no reason for doing so, and no valid arguments why it should be taken off the list-
Blah Blah Blah- it always boils down to the gaystapo whining about not being accepted with open arms, and therefore they can have ‘no dignity’. Yet pedophiles, bestiality practitioners, incestuous relationship folks all can just as equally make that same whiny claim- “Society shuns us and therefore we can have no dignity in ourselves and in the minds of the public- therefore it’s discrimination’
I’ll have to read through it more tomorrow, but it seems to me that all I’ve read so far is Bonauto whining about gay people being seen as ‘second class citizens’, and he certainly hasn’t given a valid argument why they should be taken off the list of immoral behaviors
