FULL TITLE: Immigration Executive Actions Lawsuit News: Fifth Circuit Court of Appeals to Expedite Obama Executive Action Lawsuit Hearing

The U.S. Fifth Circuit U.S. Court of Appeals announced it will expedite the process regarding the Obama administration's appeal against the temporary injunction ruling by  U.S. District Judge Andrew Hanen of the Southern District of Texas' Brownsville Division. Hanen's temporary injunction, which was issued on Feb. 16, paused the administration's plans to implement the expanded guidelines of the Deferred Action for Childhood Arrivals (DACA) and new Deferred Action for Parental Accountability (DAPA) programs.

Those programs would grant approximately 4.9 million eligible undocumented immigrants the opportunity to stay in the U.S., avoid deportation for three years and obtain a work permit.

The Fifth Circuit Court of Appeals confirmed a court hearing for April 17 to determine if the temporary injunction on Obama's immigration executive actions should be lifted.

Hanen's ruling went in favor of 26 states who are seeking to block the deferred action programs. The lawsuit, led by Texas Attorney General Ken Paxton, includes Arizona, Arkansas, Florida, Georgia, Idaho, Indiana, Kansas, Louisiana, Maine, Michigan, Mississippi, Montana, Nebraska, Nevada, North Carolina, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Utah, West Virginia and Wisconsin. Following the Fifth Circuit Court's announcement, Paxton said reiterated the lawsuit's mission against Obama's "illegal amnesty."

"The rule of law is at the very heart of our case against President Obama's lawless immigration action. We are a nation of laws, and we are proud to lead a bipartisan coalition of 26 states fighting this Administration's unilateral and unconstitutional use of executive power. We will vigorously oppose the president's illegal amnesty plan in court."

The lawsuit was originally set up by then-Texas Attorney General Greg Abbott, who has since become the state's governor. On Tuesday, Abbott's office announced he filed an amicus brief against the Obama administration's appeal. The amicus brief was also signed by the governors of Louisiana, New Jersey and South Dakota.

"President Obama and his lawyers have shown an alarming lack of respect for the Rule of Law throughout this entire judicial process," Abbott said in a statement. "I expect their request for a stay to be denied so these proceedings can continue, and I am confident the case will ultimately result in victory not only for the State of Texas, but also for the Constitution of the United States."

The 5th is heavily tilted toward Republican nominees -- 15 by Republican presidents to 7 nominated by Democrats.

If Obama can give amnesty to these 5 million, he’ll simply take it as a sign he can give it to the rest of the illegal immigrants the next day. At that point, what would be the purpose of the constitution? Any competent judge would rule against Obama and say, “If you want to enact these measures, you must go through congress and sign a bill into law. Next case!!! It will be a sad day if we don’t get that ruling, and it will still be a sad day if it’s not a 9-0 ruling against the President.

I truly believe if Obama loses on executive amnesty he won’t take it with dignity and grace. He’ll give stem-winder speeches about ‘right-wing’ control of the courts and call for national protests (IE-violence). Same thing would happen if he loses on Obamacare. He’s a community organizer....and he will organize his followers fast. Obama is a very bad person....just look at what church he attended for 20 years.

If so, I would imagine that Obama knows he would lose, but is doing this so that they can claim a basis for violating the District Judge's injunction by saying it was on appeal. They will go from the 5th to the Supremes after that, and continue handing out ID cards, and the Supremes might not intervene, but will take months to decide. Legally, they have no basis to violate the courts orders while they seek this relief, but their appeal is not to the courts, but to the LIVs and the King of LIVs, John Liebowitz.

I hope the District Judge gets more aggressive with the administration. He should require a list of all the illegals who were given cards in violation of the order, then require the administration to contact them and advise them that the cards are revoked as never validly issued, and then publicly announce the same.

If the 5th denies the administration's request to remove the injunction, they will undoubtedly appeal to the SCOTUS. It's not likely that SCOTUS would touch it until after the case has been to trial in the lower courts, though, so it would be very likely end up back in front of Hanen's court for trial. If the administration loses there, they would normally need to appeal the decision to the 5th circuit before it even reached SCOTUS again. All of this could take years...

Does the fact that Judge hanen is considering action for the DOJ lying to him, have any bearing on this appeal?
