Congress? We don’t need no stinking Congress. Obama has shown it is not necessary. Cruz could simply sign an executive order, or maybe have one of his cabinet members write a memo, directing the government to ignore all rules, and laws associated with Obamacare, and sit back to wait for states, corporations, or individual citizens to sue.
