Why doesn’t Obama just pardon Hillary?

President Obama doesn’t need his phone for this job — just a pen. With but a stroke of it, he could pardon Hillary Clinton for any crimes she may have committed in Emailgate and spare the rest of us the long drama.

At first blush that might seem ridiculous. Though the press is rattling on about how the former secretary of state has broken all sorts of federal laws in connection with her email, Clinton hasn’t been formally accused of anything.

That doesn’t mean that she couldn’t get a presidential pardon. Richard Nixon hadn’t been indicted for any crime when President Gerald Ford gave him a pardon.

Nor had most of the Vietnam-era draft dodgers whom President Jimmy Carter pardoned (on his first day in office).

Fact is that the pardon is the least-fettered presidential power. The president can pardon anyone for any offense against the United States, except in cases of impeachment.....

D.C. WHISPERS: Clinton Machine Bracing For Pay To Play Scandal

Is the private server/missing email scandal actually a distraction from a much larger and far more damaging legal issue that would not only topple Hillary Clinton’s 2016 run but also link the Clinton Foundation swamp to the Organizing for Action political monstrosity, and thus, the Obama White House?

It’s an interesting idea from another angle. Issuance of a pardon for Hillary during her political campaign would certainly compromise it and might even derail it, given that it would suddenly and sharply focus on her performance in office. Not that 0bama would ever want to sabotage Hil...

He will but he’s got to indict her first. Then he can trade a pardon for a promise to clear the field for Comrade Warren.

Oh, I think the scandal will be the discovery that the Clinton Foundation curried favors (and got them) with people closely tied to the Muslim Brotherhood, a group known to have close ties to extremists in al-Qaeda and ISIS. If that is true, then the political firestorm could be so gigantic against Hillary Clinton that she may never ever start a Presidential campaign--and all h*** breaks loose on the Democratic side as we could end up with a large number of candidates on the Democratic side in 2016--something that both George Soros and Tom Steyer will not relish.

Maybe so, but Lipsky mentions two precedents to the contrary (Ford pardoning Nixon prospectively and Carter pardoning the Vietnam draft dodgers both prospectively and as a class, as opposed to a list of specific individuals). Moreover, neither Congress nor the Supreme Court has the power to overturn a pardon.
