I don't know the "law" well enough to say that.
But I do know the state of executive lawlessness well enough to say that we had better start worrying a lot less about legal niceties and a lot more about saving the republic from near certain destruction. They are [metaphorically] gunning us down in the streets while we are waving Robert's Rules of Order & whining "that's not nice".
Will we destroy the republic by abandoning the finer points of law to fight these barbarians? Possibly. But it is a 100% guarantee that the republic is fini if we keep up with our current "lead with the chin" strategy.
Steppenwolf should re-release "Monster", maybe someone will listen to it.
