Great question. I can’t find ANY recent update articles on Hanen’s ruling.

To undercut the ruling.
Boehner forcefully promotes Obama’s agenda. Again. And again. And again.
I think he is ruling on lifting the stay which is highly doubtful given the narrowness of his stay ruling. (Obama almost did not file for relief).
But your point is valid, as a compromise, could DHS funding be passed and funding for Obama's executive orders be suspending pending the court's ruling. Otherwise the GOP supports funding in the courts that is in violation of the law.
You can expect the administration to file a statement with the court that announces that both houses of Congress just appropriated the funding for this initiative without stipulations or exclusions. They did so with full knowledge of how the initiative would be administered. The court should consider the action of Congress as approval for the program and release its stay immediately.
