Living in CO I have mixed feelings about this, I don’t smoke anything, but I would like to see parity in smoking laws in areas like boulder where it is illegal to smoke tobacco in certain areas, but legal to toke up....
Basically I want to stick it to the hippies.

The owners of a mountain hotel and a southern Colorado horse farm argue in a pair of lawsuits filed Thursday in U.S. District Court in Denver that the 2012 marijuana-legalization measure has hurt their property and that the marijuana industry is stinky and attracts unsavory visitors.” Unsavory visiters to CO? South Park CO???
Do they look like this?

Now, the state faces groundbreaking lawsuits from its own residents, who are asking a federal judge to order the new recreational industry to close. What a terrible thing to do: further cement the idea that federal government is superior to the States in all matters
… if you ascribe to that then there is no 9th and 10th Amendment and, moreover, you implicitly agree with the interpretation
of the Constitution that allows the NSA's domestic espionage, the BATFE's regulation of firearms, and the imposition of same-sex marriage upon the States.
It's one way or the other: you cannot have the Federal government be superior only when it conveniently lines up with your personal philosophies.

A horse farm calling another industry “stinky”? The irony is rich!
To: Tolerance Sucks Rocks
C’mon folks your argument is stinky and unsavory; if that works every city; county dump in the country could be declared illegal, in fact some on could sue the horse farm for the very same reason.

However unsavory one might consider legalized marijuana, it would be wise and correct for conservatives to support Colorado in this case, thereby opposing the claim that federal law has primacy over state law Iin areas not clearly defined in the Constitution as the purview of congress.

the owner of a Pueblo County horse farm, Hope Reilly, who said Thursday that shes been horrified to see a marijuana cultivation facility go up next door. Reilly, ... says the pot facility mars spectacular views of the Rocky Mountains.IOW, she would presumably object to any other use of the land that might impact her view.
Suspect the horse farm owner is an elitist who feels entitled to have the government prevent others from productive activities so it won't hurt her view.
Much like Teddy objecting to wind farms off Cape Cod.

Interesting that the reasons these people don’t want legalized pot has nothing to do with the claims made in the suit. There are already laws about odor, running a business that is a nuisance, etc. Just enforce the laws on the books.
The CO legislature didn’t legalize pot. The citizens voted by referendum to enshrine legalized pot in the state constitution.
My Colorado town outlawed all pot grows/shops/etc. by citizen vote. Which is perfectly legal too.
Imagine, someone besides the federal govt making local decisions.

This land means a great deal to me, said Reilly, who says the pot facility mars spectacular views of the Rocky Mountains. You don't own that land or the view, Ms. Reilly - stop trying to use the courts to steal.
