Rather than making the funding fight moot, conservatives argue, the ruling shows why Congress cant let Obamas policies stand.
A Texas judges rejection of President Barack Obamas immigration actions has strengthened conservatives resolve to use the Department of Homeland Security funding bill to oppose his moves potentially complicating efforts for a quick end to the partisan standoff just 10 days before the clock runs out.
Rather than defusing the conflict on Capitol Hill by making it moot, conservative lawmakers and senior aides said Tuesday, the ruling by U.S. District Judge Andrew Hanen makes it even clearer that Congress cannot allow Obamas actions to stand. The president has acted unconstitutionally, and it is the president not Congress who must back down, said Sen. Jeff Sessions (R-Ala.), an immigration hard-liner.
Instead, Republicans said, its the Senate Democrats who need to give in by allowing a vote on a House-passed DHS bill that would block the presidents efforts to protect millions of undocumented immigrants from deportation.
This court ruling certainly does provide us with an important, I think, a helpful argument to fund everything but what a federal district court has ruled as unlawful or unconstitutional, Wisconsin Sen. Ron Johnson, a vulnerable Republican and chairman of the Homeland Security and Governmental Affairs Committee, said in a telephone interview Tuesday. We all want to keep this nation safe and secure, so lets do that. Lets not fund whats in dispute.

I was planning on making some phone calls. Are they even there this week? Congressmen are always on vacation.
I imagine that he’ll change the order in some meaningless way, e.g. modify the font from Calibri to Arial, and resubmit it. Either that, or shop for a more sympathetic court.
Possibly both.
