Obama vows to abide by court order: President sought to stop deportation of as many as 5 million

A federal judge in Texas has temporarily blocked President Barack Obama's executive action on immigration, which has drawn opposition from 26 states across the nation.

United States District Judge Andrew Hanen ruled late Monday night to block executive actions Obama took late last year to shield as many as 5 million undocumented immigrants from deportation. In delaying the ruling, Hanen halted Obama's executive action, ruling that the administration had failed to comply with the Administrative Procedure Act, which calls for the White House to afford a longer notification and comment period before taking action.

The White House said in a statement early Tuesday that Obama's actions "are well within his legal authority" and that the Justice Department has indicated "that it will appeal that decision."

"The district court's decision wrongly prevents these lawful, commonsense policies from taking effect," the White House said in a statement....

In 1992, Hanen was nominated by President George H. W. Bush to be a United States District Judge, but the nomination lapsed.[1] On January 23, 2002, he was again nominated by President George W. Bush to a seat on the United States District Court for the Southern District of Texas vacated by Filemon Vela, Sr. Hanen was confirmed by a 97-0 vote of the United States Senate on May 9, 2002,[2] and received his commission on May 10, 2002.

I smell a setup here. Now the Pubs can say that the issue is moot and pass a “clean” Homeland Security bill. Once it’s signed, an appeals court overturns the stay, and everybody’s happy (well, the RATS and the GOP-e anyway).

I’m still amazed that a sitting U.S. President is “protecting” Fraudulently Documented Foreigners from the very laws he swore an oath to “faithfully execute”.

Maybe he thinks that means to kill the laws.....

It’s really strange: He “says” he’ll abide by a judge’s decision, when he won’t abide by duly enacted legislation or the Constitution. Just shows you that these Marxists really do want to rule by edict.

I may be wrong but I believe this decision already conflicts with Judge Howell’s decision in the DC District.

She threw out Arpaio’s suit saying that he had not suffered any damage yet and therefore didn’t have standing.

Hanen just explicitly agreed the States have standing and that even though it hasn’t started yet, they do stand to suffer damage (doh).

Maybe it’s a stretch but seems to be a conflict. Any conflict ends up in the SCOTUS, after going through the Federal Appellate courts.

So we may not have to wait for Richard Paez and the Spanish Inquisition of San Francisco to weigh in.

Any lawyuhs on line please correct my understanding....

It’s all chatterspeak to fend off the rubes.

They have no intention of complying with it and are plotting whatever nuclear option they can think of.

Somebody in the Wet Ops group is currently tracking down any dirt they can find on the likely Appellate court judges who will be leaned on to overturn Hanen’s decision.

At first I went along with all the conventional wisdom that this would not last.

I wonder though. Maybe the best thing the courts could do is let the clock run out on this. If the appellate courts let this injunction stand until the hearing on the merits and the hearing on the merit takes place later and also takes some time, then further appeals take some time, then maybe we can have another election before the courts have to either:

1. allow an unconstitutional executive order they happen to agree with stand. [ie the leftist judges]

2. Slap down a president for an unconstitutional executive order picking a fight with the executive. [conservative judges]

Now maybe this will not happen but a case can be made for the judicial branch just running out the clock and hope the next election causes this issue to go away.
