It would be if the court withheld the ruse and search and subsequent application for search warrant. The court did not.

The court ruled the Agents acted wrongly and threw out the case based on 4th Amendment grounds and lying to the judge.

They did walk. The judge threw out the case on 4th Amendment grounds and lying to the judge.

I was relying upon the news article. After the reading the opinion, thanks for it, I see what happened.

I’ve known of ruses being used but indeed my uninformed opinion regarding a 4th violation on this was predicated upon the extent of the ruse to set the stage for entry. For instance, I don’t think it would be proper to set a building on fire so one could enter posing as a fire fighter. Talking one’s way in or accompaning an actual criminal informant insider is obviously as valid ruse. The instant situation seems somewhere in the middle of these two examples.

The totality of their misstatements did them in.

Except it wasn’t the suspects’ home. It was hotel property and the hotel let the feds onto hotel property.

Once you pay rent or lease the place is the same as your home. Ask any landlord who has been through an eviction process.

Speaking of search warrants or the lack thereof.......Does anyone know the protocol when presented with a search warrant?

We all know this is coming to a house near you....I’m just asking:

1.) I’ve never seen a search warrant. How can you tell if it’s real?

2.) Can you keep the JBTs on the porch while you google the judges name?

I guess law abiding citizens need to know these questions now
