Federal court rejects challenge to public school vaccination rule

A New York requirement that all children attending public school be vaccinated has been upheld by a federal court.

On Wednesday, a three-judge panel of the Second Circuit U.S. Court of Appeals upheld a regulation by New York City health and education officials. The rule was being challenged on grounds that the law was discriminatory and that its local applications violated freedom of religion.

The court also upheld a regulation that allows school officials to prevent non-immunized children from going to school during an outbreak of vaccine-preventable diseases.

The state statute was being challenged by three New York City plaintiffs, who filed against the state Department of Health, the city of New York and the New York City Department of Education, according to the Wall Street Journal.

Two of the plaintiffs were challenging why their children were excluded from school when a fellow student was diagnosed with chicken pox — though they had been exempted from the vaccination requirement for religious reasons.

The third plaintiff was challenging the rejection of her daughter’s application seeking a religious exemption for a vaccine. The New York City Department of Education said her religious claims were not based on “genuine and sincere religious beliefs.”

Attorney Patricia Finn, who represented the three plaintiffs, said she planned to appeal the decision to the U.S. Supreme Court.

“People have the right to refuse medical treatment that could harm them,” she said.

“We are pleased with this decision, which is in the best interest of the public health and protects city schoolchildren, their families and the broader community in which we all live,” a city Law Department spokesman said.

Sorry, but they should be vaccinated. Everybody, both legal and illegal.

There has been an uptick in unnecessary but dangerous diseases such as measles, and it’s not among the poor but among the liberal upper middle class who have imbibed quack science and think that vaccination is going to “give their kids autism.”

It’s like the old “sugar is poison” mantra among that group. Their kid’s bratty behavior was always explained by, “Well, I think he may have had some sugar today...”

So everyone should be vaccinated? You see no links to the increase in vaccinations and the explosion in increase of Autism - or it's onset most often following on the heals of a multi-shot with mercury-based preservative thiomersal of perhaps, also, our pesticide laden foods, etc? Some pushers are claiming it's 'genetic' - that isn't even even a clever canard. Had it to do with genetics, it would have been with us for generations. And it would not see such yearly spikes...or maybe you can explain why it might be 'genetics"?

The chart below only goes up to 2007 - but the rate of increase had continued to sky-rocket. By 2012 - 1 in 68 - now - even more.

But let's continue to ignore that elephant in the room - becasue he makes BIG $$$$

Since you seem to have the last word re vaccines, Perhaps you could share with us, not just your empirical opinion, but the facts to back it up?

I agree that vaccines are needed. BUT Some vaccines need a second look by the FDA or should never have been approved.

Gardasil is 1. First shot has ruined my 16 year old granddaughter’s life. She was into Ribbon Gymnastics, horse back riding, skiing. Now she takes 8 pills a day for FMS, RA and has food issues and more her mom won’t tell us about. RA is a progressive form of Arthritis that will put her in a wheel chair eventually.
