Yes,he was breaking the law (a misdemeanor).Yes,he did resist.But given the non-urgency of the situation (he wasn't wanted for murder or rape...he wasn't armed...he wasn't threatening anyone) his arrest could have,and should have,been handled differently.IMO one or more of the cops either demonstrated having been poorly trained or were guilty of negligence.As a juror in a criminal trial I strongly suspect I would vote not guilty but as a juror in a civil case against the City of New York I know for a fact that I'd vote to award the family serious $$$.

HOW do you know he wasn't wanted for murder or rape? How would the cops have known at the time he resisted that there indeed could have been warrants out for his arrest?

Yeah, sure, the cops should have sensed he had asthma and severe heart disease before carrying out what normally would have been a mundane arrest. Gotcha.

Maybe the police should just become like millions of spineless parents issuing ultimatums to their kids. “Stop doing that or I'm going to count to 3. Then I'll count to 3 again”. “You're under arrest, put your hands behind your back or I will count to 3, and then I’ll count to 3 again.”
