Bill would make immigration executive action illegal

Rep. Ted Yoho (R-Fla.) has introduced legislation to establish that the executive branch doesn't have the authority to defer deportations of undocumented immigrants.

President Obama's executive action is expected to affect as many as 5 million people in the U.S. illegally by expanding the Deferred Action for Child Arrivals (DACA) program and allowing parents of U.S. citizens or permanent residents to apply for work permits.

Yoho said his bill, H.R. 5759, would essentially nullify the executive action.

"An executive 'fix' of the law is unconstitutional, temporary, and will establish a very dangerous precedent," Yoho said.

The Florida Republican argued that only Congress should be responsible for enacting broad changes to immigration law.

"I, along with the American people, want to fix our broken immigration system. But this fix must come from well thought-out legislation that puts the needs of the country first," Yoho said.

Two other House Republicans introduced a bill to block Obama's executive action. Reps. Ted Poe (R-Texas) and Diane Black (R-Tenn.) wrote a bill that would prohibit funding for delaying deportations and issuing work permits.

An executive order of the President must find support in the Constitution, either in a clause granting the President specific power, or by a delegation of power by Congress to the President.

He said that they should “pass a bill”. OK. This is a bill. If he vetoes it, then he’s taking this to the next level. Maybe enough congresspeople will grow a set and impeach this POS.

What a waste of time, effort, paper and news space.
Yoyo knows this bill ain't going to get to the floor of the Senate for a vote. Not under Harry Reid or Harr er Mitch Rei er McConnell.
Even if it did, it needs the pResidents signature or 67 votes to over ride. Can anyone name me 56 yea votes? 54 yea votes? 50 yea votes?

There are 92 million of able Americans out of the work force because they cannot find employment and Obama wants to legalize and give work permits to over 11 million illegal aliens allowing them to bring here the rest of their families. In other words, another 25 or 30 million that either will compete with Americans and legal immigrants searching for scarce jobs or are going to be added to welfare, bankrupting Medicaid and the food stamp system as well as ruining even more the quality of the public schools with the massive infuse of hundreds of thousands of children without speaking English to already overburdened schools systems.

Blacks are going to be the main collateral victims of Obama’s anti-Black amnesty. Black Americans are already suffering higher unemployment since Obama took power. Obama’s new class of protected immigrants will take over their jobs and Blacks will be forced to share their welfare checks and food stamps with them.

Gruber, Obamacare’s architect called stupid the democratic voters. Obama is granting amnesty lo illegal immigrants based on the assumption that the unemployed American workers are so lazy that they do not want to do the jobs that are being done by alien workers.

Without a Major Shakeup in the Leadership in BOTH HOUSES, Nothing will happen short of bloodshed. If you stand back a little bit you just might see that Bloodshed and Civil Unrest is their End Goal. And YES the Republicans are COMPLICIT in EVERYTHING that goes on in Washington, well the Leadership Ruling Class is.

This is stupid, he will not sign it and will just taunt the Republicans with it and use it to energize his base.

Instead, they should focus on passing common sense laws. Laws that actually help the American people, like maybe a very strong border enforcement bill with teeth that would be difficult to use ‘prosecutorial discretion” in enforcement. I don't want to see threats, tantrums, interviews, etc. I want to see action! Just do it!

Exactly. I am sick and tired of all this double talk and deflection. What the bastard in Chief did is unequivocally unconstitutional. He has repeatedly violated his oath of office to protect, defend and uphold the Constitution and this is just one of the more egregious examples.

The remedy IS impeachment and conviction. Unfortunately the cretins in Congress no longer have any principles. A principled public servant would be demanding Obastards resignation or impeachment regardless of any consequences to his/her career or to the party.

Sorry, but neither the States, nor We the People, have EVER approved Congress delegating ANYTHING to the Executive branch; let alone any Department (IE unelected bureaucrats making law our of thin air ala ‘regulations’)

Course, that too was known when we HAD a Republic
